Because there is no precedent that an impeachment vote is res judicata. There were much better arguments to make.

Most justices concerned that other states will follow suit.

“Have faith in our system,” LOL. She says “institutions” will make sure states don’t overreach.

Alito asks which institutions. Word salad response.

Mitchell (Trump lawyer) back up for rebuttal: “Colorado has changed the criteria in Sec 3 that [applies it] before the candidate holds office.”

Hearing over.

The best threads at FR are election day threads and SCOTUS hearing/decision days! A lot of information is gathered in one place for easy referral.

Based on these questions I think 9-0. Jackson doesn’t have the balls to be the lone dissent.

No one forgot to bring up anything, IMHO. It wasn’t brought up because it did not or would not have helped. I can only assume this is the case.

Yes, Trump was an aberration.

Since pretty much Reagan, we have had oligarchs and dynasties selecting our Presidents.

Bush 1, Bush 2, Clinton 1, nearly Clinton 2 (she ended up in the Senate and Secretary of State), Obama (selected) Biden (selected). So often we forget what happens at the DNC or we choose not to watch it, when we actually should be. Recall Obama’s selection was like a coronation.

For whatever reason I beg that we look backwards and come to terms with the fact we have not truly voted in decades.

Trump’s attorney was calm, professional, engaging, prepared. Colorado’s attorney ‘lost it’…..he sounded like a scared kid

You confuse a winning case and tone of voice as a good argument. This case will be studied for decades, and the transcript will show that Trump's attorney Jonathan Mitchell was either unqualified for the task or compromised by outside forces. His brief and his argument needlessly conceded important points critical to his client. Luckily, almost all the justices could see the importance of the issue and did his job for him.

America finds itself at a crossroads. We were given a Constitution, written in plain English, that set limits on Federal power. Since human nature never changes, the three “equal” branches of government are always jockeying for the rail. I consider Congress the villain in all this as they have abandoned their responsibilities to the Executive and Judicial Branches while they are only primarily interested in growing government (increasing their power) and spending money to enrich themselves and their supporters. The Executive branch has stepped into the vacuum by de facto creation of laws via Executive Order (unconstitutional) and growing its branch. The Judicial Branch which was set up to interpret the Constitution AS WRITTEN, and act as a break on the other 2 Branches has also fallen victim to its own hubris by creating laws from the bench and ruling to a certain extent by Judicial decree. I believe there are still good people in the 3 branches, but they are neither strong enough or numerous enough to stop what’s coming. Pray for our Republic.

Can they refuse to accept the electors - that is the question being left open - NO!.. They CANNOT refuse.. That was the "STAND" that was taken in 2020...

I believe 2020 was the result of there not being enough thorough bred R's to vote on reviewing various state certifications as conforming with those state constitutions. Which what was frightened Pelosi into action.

I disagree. He focused on the strongest arguments and didn’t get sidetracked. Very good job.

From what I’m hearing and inferring, I suspect this will be a 9-0 decision.

It SHOULD be but wont. The left will demand one of the left write a dissent for them to hand "THEIR truth" on and let the commie media run with it.

KJB, because she’s just not smart.
Sotomayor, to cover KJB’s abject incompetence.
