Justice Ruth Bader Ginsburgs recent health problems have revealed a rift among Senate Republicans over what to do if a Supreme Court seat becomes vacant before the end of President Trumps first term.
While Senate majority leader Mitch McConnell (R., Ky.) has indicated his intent to fill any Supreme Court vacancies in 2020, other Republicans are more hesitant.
Senator Lisa Murkowski (R., Alaska), expressed concern that confirming a Trump nominee before the end of the presidents term would create a double standard after Republicans in 2016 declined to appoint then-President Obamas nominee Merrick Garland to fill the seat vacated by conservative justice Antonin Scalias death.

If Trump got the chance to fill a Supreme Court seat before the election he wouldn’t have fifty votes to confirm him. Murkowski, Romney, Collins, Gardner would all vote against confirmation. Maybe Grassley and a few others as well.

Exactly...We have the Senate and the Presidency. Obama had only the Whitehouse. The Repubs had the Senate. Would they have given Garland a hard time if nominated...cuz we’re not like the Dems. And we know nothing about Garland...because it didn’t happen.

The argument was the electorate will decide which vision they embrace come November - the Republican candidate's or the Democrat's.
