A nurse says she was assaulted and illegally arrested by a Salt Lake City police detective for following a hospital policy that does not allow blood draws from unconscious patients.
Footage from University Hospital and officer body cameras shows Detective Jeff Payne and nurse Alex Wubbels in a standoff over whether the policeman should be allowed to get a blood sample from a patient who had been injured in a July 26 collision in northern Utah that left another driver dead.
Wubbels says blood cannot be taken from an unconscious patient unless the patient is under arrest, unless there is a warrant allowing the draw or unless the patient consents. The detective acknowledges in the footage that none of those requirements is in place, but he insists that he has the authority to obtain the draw, according to the footage.

Detective Jeff 'Barney' Payne physically assaulted that nurse. With any luck, he'll be spending some time in USP Draper. In any event, I believe that Ms. Wubbels soon won't have to be concerned about working for a living, only working because she wants to, courtesy of the State paying out BIGLY for that power tripping rozzer!
Before you get your tighty whities in a knot, I support honest policing. Unfortunately, there seems to be fewer and fewer honest cops and many more like this bully!
The video tape is damning evidence against the cop. He should lose his job over this.

He would be lucky to just lose his job. The DA is launching a criminal investigation, with the full support of the the Police Chief and the Mayor.

And without that video the cop would have claimed the nurse assaulted him.

If the cops are wrong, they are wrong, but we live in a civilized rule of law nation.
The police listened to her act as messenger for higher ups did not act against her/their will.
Yet in turn she acted against the police will by screaming and revisiting arrest.
That would have been equivalent to the police ignoring the hospital’s statements taking blood anyhow.
One side did not hold up their side of the bargain.
Screaming like an idiot.
And we are supposed to respect her?
Are we supposed to respect the guy on the phone telling her what to do for being a coward and leaving it to a nurse?
It’s threads like this and events like this that show even conservatives are really liberals who do not believe in civil society or rule of law.

Uh, he went after the nurse BEFORE saying she was under arrest. Instant instinct to try to get away and then scream for help kicked in - I doubt she even comprehended anything he said for at least several seconds. (I have noticed something like this in my own daughter, in lighter situations: She is afraid of spiders. If she unexpectedly sees one close by, she does not scream “Help, Daddy (or Mommy) - get this spider!” She just screams, or screams “Help!” “What’s wrong?!” gets me another scream. Most of her friends act similarly [not necessarily with regard to spiders.] This is not from me or her Mom, “Mom” lets harmless spiders crawl on herself and laughs!)
Prior to Payne lunging at her, at no point did I see Nurse Wubbels make any physical move to resist, impede, etc.
As for the hospital supervisor on the phone, who knows if he was even in the building, or perhaps tied up with another patient. The cop could hear what the supervisor was saying - we can even hear part of it in the vid. (Ok, I do have good headphones.)
That said, it seems to me both the nurse and the cop are at fault for not having their respective supervisors talk to each other. This does not excuse the cop’s behavior in any way.
All - There are comments that this cop has had “issues” before - can anyone document?

As far as law goes, which takes precedence, regs. for truckers, or HIPPA? Where would T. Jefferson or J. Adams come down on that?

And what probable cause did the cop have that the victim of a head on collision by a criminal fleeing the law committed a crime? And according to the Supreme Court you need a warrant to take blood. Last time I checked the Supreme Court trumps any state court.
The detective should have talked to her boss or a higher up.
Soitenly. I got the wrong time frames for the tests, though. It's 2 hrs for alcohol and 32 for controlled substances. Also, the tests are to be provided for by the company, not the police or other govt. agency. If the tests can't be done in those required timeframes, then they're not to be done at alll. The law specifically states that. If they aren't done, then an explanation must be filed by the company as to why. I take that to mean it will be a case-by-case basis on what happens with the driver regarding his license.
In this case, I'd bet, if he wakes up, and if he can do so physically, he'll maintain his CDL. The video of the wreck would certainly exonerate him.

No way was the hospital arguing HIPPA.
Unless everyone is changing the story and the article and everyone who said it was a fifth amendment issue yesterday is wrong.
Say what? The Fifth Amendment protects individuals against being compelled to testify against themselves. Somebody is very confused about the Constitution. Who is it, you or this "everyone yesterday" that you're indirectly citing?

Cops need to be schooled in basic constitutional law.
This foolish action should likely land the cop in jail, and put Salt lake City in jeopardy for a massive judgment.

The man the nurse was “protecting” was the victim of a criminal that was fleeing from law enforcement officers.
