Chief Justice Appears To Take Shot Across Gorsuch’s Bow

In remarks given at a judicial conference in Pennsylvania this week, Roberts reiterated his long-held view that the Court should speak with one voice wherever possible — that is to say, he supports a consensus-driven approach to opinion writing in which the justices strive for unanimity and avoid writing their own concurrences or dissents. In doing so, he appeared to rebuke Gorsuch, who has flashed a propensity for writing on his own in his first months as a justice.

If it can be proven that Roberts truly was blackmailed in the Obamacare case, I wonder if it would be possible to render that decision void. That would turn the clock back to the day before the vote.

I remember when I heard how Roberts had voted - in the car leaving the airport. I almost puked.

Ah, yes. Chief Justice Roberts who ruled Obama care was a tax and ignored the fact that it originated in the Senate when all tax bills must originate in the House.

Consensus - how the left tries to drive the conversation THEIR way by forcing others to moderate their positions. I hope Gorsuch gives Roberts the middle finger.

Roberts can't take away Gorsuch’s votes. He can't censure him. He can't remove him from the court. He might as well shut up and attend his cocktail parties, which is apparently the MOST important thing in his life. It must be disappointing for him to look in the mirror each morning and realize that he once had principles.

This CJ gripe is tripe, it's small ball. I want to know the exact Gorsuch cite to which CJ complains. Probably Trinity Lutheran Church v. Comer. Well, John Bob, you're going to get a 6-3 Court soon enough and maybe then it's time for a new Chief Justice...

You could certainly be correct - the Daily Caller is supposed to be leaning toward our side.

When Roberts first took the reins, I had thought that his ideas of trying to get strong majority decisions was good, but most likely unworkable. That's become more obvious as time as passed, but I suppose if he's truly going after Gorsuch, that's to our detriment: it would be as if he's trying to put the brakes on another Thomas-Scalia-esque partnership before it begins.

Exactly my thoughts....until a recent decision, one would be hard-pressed to find a SCOTUS decision that represented a greater majority than one justice.

The O-care ruling was a complete betrayal.

It was not only a betrayal, but he re-wrote the law to make it a tax, when the Bowbama bunch kept saying it wasn't, thus making it a law. Yes! Total betrayal!

BTW, I'm a Taylor kinda guy, with Gibson's and Epiphones mixed in.

Dissents sometimes become tomorrow’s majority opinion. Justice Harlan was the sole dissenter in Plessy v Ferguson, where the SCOTUS majority held that separate but equal should prevail. That all changed some 50 years later when Brown v Board of education reversed the Plessy Majority. Dissents to Roberts’ votes will surely become law someday too.
