Lawrence Sellin, Ph.D. a retired colonel with 29 years of experience in the US Army Reserve, argues that Senator Ted Cruz entered the United States illegally as a child in 1974. His parents failed to file a CRBA form which is required by US law. Ted’s parents did not fill out the required form until 1986.

I spent a little time on a site that offered help for Americans living in Canada in renouncing American citizenship. Link to site

There is a woman claiming to have lived next door to the Cruz household in Calgary who says Ms Wilson/Cruz did just that and that the consulate in Calgary told Ms Wilson/Cruz that her child had no American status because of her renunciation so I looked into the mechanics to see if it was plausible. People can claim anything but the issues raised just support that the situation is murky and needs to be addressed by Cruz.

One Example among many given: Lynne, London, Ont.

When Lynne took the Canadian citizenship oath in 1973, neither Canada nor the United States recognized dual citizenship: By taking on one, she shed the other.

"It had a lot to do with the Vietnam era," she explains. "The environment in Canada was the complete opposite of the environment in the United States. In the United States, young people were furious at their government and hated Nixon. In Montreal, people were still on a high from Expo '67."

"When I became a Canadian citizen, I phoned the U.S. consulate to see how it would affect my U.S. citizenship, and I was told clearly, firmly and directly that I was permanently and irrevocably relinquishing my U.S. citizenship. I was told there was no turning back, I was told to think very carefully, because this decision was not reversible, that I was young - I was 22 at the time - and that there was a very good possibility that I would change my mind."

Any person who is a national and citizen of the United States at birth under paragraph (7) of subsection (a), shall lose his nationality and citizenship unless he shall come to the United States prior to attaining the age of twenty-three years and shall immediately following any such coming be continuously physically present in the United States for at least five years: Provided, That such physical presence follows the attainment of of the age of fourteen years and precedes the age of twenty-eight years.

We need to have a lawyer proof definition of natural born citizen ASAP. I’d also like to clear up the birthright for illegals. Anchor babies is wrong, as is pregnancy tourism. Only children born here to legal residents should have birthright. Period.

I would add that this “continuously physically present” recitation causes considerable heartburn. There are probably hundreds of deportation cases that hinge on this, especially those who live near the US-Mexico border and “go home” (to Mexico) on an annual basis for some sort of family get together.

What about all the other illegal immigrants who have committed no “crimes” EXCEPT the ORIGINAL crime of entering the United States ILLEGALLY? He didn’t say those “who have broken the law”, he references only “Crimes.”

I’m not surprised I overlooked this - focused on the intial grant of citizenship being naturalization, and pointing out SCOTUS cases that recognize this type of citizenship as a form of naturalization.

State Department says that the CRBA replaced the Certification of Report of Birth in 2010.

He would not have been a citizen when he first arrived in the USA, but he would be a citizen now after she applied for his CRBA when he was a teenager. It has to be done before the person is 18 or he can lose his right to apply for citizenship.

So if the CRBA was applied for much later, he can legally hold the Senate seat. However, he should not be running for President, as he is not a Natural Born Citizen and he lied to the American people about his Canadian citizenship.
