Donald Trump defends his vocal support for eminent domain: ‘I think it’s a wonderful thing’
Washington Post ^ | 10/06/2015 | By Jenna Johnson

Even though it's a stance not especially popular with some Republicans, Donald Trump continued to support eminent domain in an interview on Tuesday, calling it "a wonderful thing" that has unfairly received a bad rap.

Trump, a billionaire known for his major real estate development projects, described eminent domain as a useful tool that local governments can use to prevent greedy homeowners from derailing major projects that could create thousands of jobs or provide a public good. Trump said that some conservatives don't fully understand how eminent domain works and don't realize that homeowners are usually paid "four, five, six, ten times" what their property is actually worth.

"Eminent domain, when it comes to jobs, roads, the public good, I think it's a wonderful thing," Trump said during an interview with Fox News's Bret Baier that aired Tuesday evening. "And remember, you're not taking property… you're paying a fortune for that property."

Trump's support of eminent domain, along with his use of the practice professionally, has prompted some criticism from conservatives.Republican presidential rival Rand Paul has slammed Trump over his eminent domain views, calling the mogul “a big fan” of the practice who has “shown no consideration for small private property owners."

The super PAC for the Club for Growth, a fiscally conservative advocacy group, recently aired television advertisements in Iowa that accuse Trump of supporting "eminent domain abuse" that would allow him to "make millions while we lose our property rights." Trump said the Club for Growth's attacks have come only because he refused to donate $1 million to their cause. He added that the spots are "not right" and do not accurately explain eminent domain.

I can agree that private acquisition is not covered under common good. My comment was we get paid in ED which is not true when property is taken for failure to pay tax because the state thinks they own it.

It is going to be impossible for those who hate Trump to find a perfect candidate to vote for. I will pick the one with more pro than con that others will also vote for. Liberal frenzy regarding Trump is a good indicator that he has them scared of upsetting the One World agenda. In fact in today’s America Christ would be hard put to win. Very depressing.

I’d rather preserve the culture FIRST, then worry about Gov’t over-reach.

This immigration wave is something that once it’s here will never go away.

I read parts of it, where the lady was offered one million dollars for the property that cost her twenty thousand. I don’t feel led to try to unravel all of that.

I will say, the Republicans who voted for TPA and will for TPP are surrendering the entire economy and I wish this much venom could be mustered against them. Up against those two trade deals, Kelo is nonexistent.

RE: I’d rather preserve the culture FIRST, then worry about Gov’t over-reach.

Why can’t we do BOTH?

Why not elect someone who WILL DO BOTH?

RE: So you’d rather not apply eminent domain (where necessary) to build a border wall….

THAT is the reason why eminent domain is in the constitution, NOT for taking from a private property owner in order to give it to another private property developer to build hotels or such ( as in Kelo vs City of New London ), but to DEFEND the country.

So yes, building a border wall IS legitimate constitutional application of eminent domain.

“THAT is what you should understand as to why this is a controversy.”

Okay, draw a line in the sand over that one. Then turn around and vote for someone who votes for TPA/TPP that ransacks the entire American economy.

And ALL the Republican candidates except Trump are for amnesty.

Did you hear Rush relate the findings from Senator Sessions about the projection of legal immigration for the next 40 years? By 2060, there will be 7 births from foreigners to 1 American birth.

But you can comfort yourself with the sure knowledge that you traded Kelo for the country.

Trumps’ not perfect ... therefore we must all get behind Senator Cruz, who can’t poll past Governor Bush in most polls, and lose another presidential election. Folks we don’t have any other place to go (Bush, Rubio, Fiorinia, Kasich blah blah dee frickin blah etc) - it be time to prioritize. Need to have a land to have land to worry about.

What you are saying could very well happen - If there is no wall and deporting, yes that would suck. Trump is the only one proposing plans to act in the manner most of realize is necessary.

The best thing about Kelo is when a group tried to get Justice Souter's house using it.

Anyhow I believe most of us think its America is pretty far gone as it is. I guess I'm thinking these days that Trump is worth risk.

Beside you shouldn't play Kelo the odds are worse than craps.

I’m with you on that—BOTH would be ideal and it’s not an either or deal.

Unfortunately all of the candidates (save Trump) want some sort of pathway for the pathogens invading this country.

E/D is pure evil IMO—there’s enough push-back from both sides of the aisle on it. Immigration, not so much.

The difference between “use” and “purpose” is semantics. Did you think that when government seized property in order to lay down the Transcontinental Railroad, the land did not ultimately go to private entities? When they seized land for utilities, do you think there weren’t private-owned utilities that ended up as owners?

Thats a very good point. I can’t remember a candidate ever being as forthright on positions, the situation they find themselves in as a candidate, and what they think of the press. Also Trump is right on guns which makes being wrong on Kelo less consequential.

"Your right - it will take a village."

A "village" of Trump fanatics, no doubt./S

America is a singular, unique nation of laws--not men-- opportunity, freedom, and religious liberty, founded upon Judeo-Christian principles and dedicated to Jesus Christ by its earliest settlers. Men have shed blood and died in the effort to create it and to keep it since the days of the Revolution.

How dare you attempt to attribute its greatness to one personality---to a gasbag reality show celebrity.

I'm not surprised, though, that you would use a liberal catchphrase popularized by Hillary Clinton. It's very fitting for you.

I remember that! ...

And of course the POS fought it tooth and nail.

Souter didn’t like it too much when the shoe was on the other foot.

You mean Trumpers are selling out their beliefs because they like celebrities?

No way.

That's the truth. I can understand supporting Trump for various utilitarian reasons (although I don't agree with them), but people need to quit pretending he's a conservative. To see folks on here parroting the Kelo-style eminent domain scams as a "great deal for everyone" involved, or necessary for economic development, obviously don't know the issue and have never spent a second of their lives reading about it.

Eminent domain abuse is probably the worst example of big government-corporate cronyism crushing the little guy that has ever existed in this country, yet I'm seeing Freepers regurgitate Trump one liners like it's an argument. Just proof that no ideological side has immunity to cult of personality.

The way I understand it, Trump wanted to build something someplace and attempted to obtain the land in question. The landowner refused the offer so Trump availed himself of the court system. Maybe he succeeded, maybe he didn't. I don't profess to know how the situation turned out.

There's no excuse for a Freeper to be ignorant in 2015. You could have tried Google:

TRUMPED: The Donald, The Widow and Eminent Domain

Sneak preview, the property owner won. And yes, I CAN fault a businessman for taking "all legal avenues" when those avenues are unjust and wrong.

Can we use eminent domain to reclaim the White House from B.O. and put it to a good public use instead?

Point is, I didn't care to know. And the fact that Trump did not prevail in that particular case is fine. He went through the proper process. When you are a land developer, you are not going to win every time. You will get turned down a lot by zoning boards, courts, etc.

I think Trump wanted to build the tallest building in the world on the West Side but was turned down. So...he built a bunch of buildings that were shorter. So it goes.
