Judge George Greer ruled that the State of Florida has no right to take custody of Terri Schiavo, which ruling came hours after an appeal by Terri's parents to re-insert the feeding tube was refused by the U.S. Supreme Court.

Meanwhile, another hearing was scheduled tonight before US District Judge James D. Whittemore .. the same judge who previously heard and denied the request subsequent to the 'de novo' intention of the law past last weekend by the Congress and signed by President Bush, in an effort to confirm that no stone was left unturned before Terri would endure legally sanctioned dehydration until death.

They must continue the lie that judges make the law....

I should add: They must continue the lie that judges make the law, AND THAT THEY HAVE ULTIMATE AUTHORITY AND FINAL SAY ON ALL MATTERS. They are "supreme," even the lowly Judge Greer.

I agree, just heard on the radio that there is also a request for him to recuse himself. Maybe this will be able to be pursued in the federal court when he denies it. I hope they have the appeal papers ready to roll once he does.
Greer has been sked to recuse himself previously but there was no other avenue to pursue as far as I know.

38.10 Disqualification of judge for prejudice; application; affidavits; etc.--Whenever a party to any action or proceeding makes and files an affidavit stating fear that he or she will not receive a fair trial in the court where the suit is pending on account of the prejudice of the judge of that court against the applicant or in favor of the adverse party, the judge shall proceed no further, but another judge shall be designated in the manner prescribed by the laws of this state for the substitution of judges for the trial of causes in which the presiding judge is disqualified. Every such affidavit shall state the facts and the reasons for the belief that any such bias or prejudice exists and shall be accompanied by a certificate of counsel of record that such affidavit and application are made in good faith. However, when any party to any action has suggested the disqualification of a trial judge and an order has been made admitting the disqualification of such judge and another judge has been assigned and transferred to act in lieu of the judge so held to be disqualified, the judge so assigned and transferred is not disqualified on account of alleged prejudice against the party making the suggestion in the first instance, or in favor of the adverse party, unless such judge admits and holds that it is then a fact that he or she does not stand fair and impartial between the parties. If such judge holds, rules, and adjudges that he or she does stand fair and impartial as between the parties and their respective interests, he or she shall cause such ruling to be entered on the minutes of the court and shall proceed to preside as judge in the pending cause. The ruling of such judge may be assigned as error and may be reviewed as are other rulings of the trial court.

I'd like to see Dateline NBC investigate all the allegations an innuendos against Michael Schiavo. Treat him like they treated Scott Peterson--with justifiable suspicion.

In addition, the woman can swallow, she has been tube fed due to her husbands threats to not feed her any other way. They removed the tube, but if she isn't able to swallow, why the arrest of people trying to bring her water? why not let a priest in to allow communion? why deny her fluid?

My point is she is not being kept alive by feeding tube, if she can swallow. It's not removal of life support, it's is death by starvation. Quite different.

Excuse me, but I'm not "bashing" anyone.
I'm merely asking for some clarification, because I think maybe I missed something. A few days ago he had a joint press conference with DCF officials where it was stated that the DCF didn't need the court's authorization. Now it looks like he's saying the opposite. What happened? If the DCF doesn't need the court's authorization, how can the courts have the authority to bar the DCF from acting?

Here's the legal definition for ya:

Qui Tam Action


(kwee tam) n. Latin meaning "who as well," Lawsuit brought by a private citizen (a whistle blower) against someone or a company who is considered to have violated the law when performing a contract with the government or violated a government regulation when a statute exists to provide remedies for such violations. Quit tam suits are brought for "the government as well as the plaintiff." In such actions, the plaintiff is entitled to a percentage of the penalties recovered (which may include large amounts for breach of contract) as a reward for recovering funds for the government by exposing the wrongdoing. The federal or state government will get involved and become a party to the suit, being part of any negotiations and conduct of the case in order to guarantee success. This type of action generally involves significant violates that involve criminal or fraudulent acts, not necessarily technical violations and/or errors.

I believe it!

Terri is suffering in a Hospice bed, while Jeb (who left his spine somewhere) is just fine in the Governor's mansion. He wants us to give up the fight just because he has.

He's saying, "Ooooooooh, everybody just stop expecting anything from me. Ok?"

{{{hugs}}} You MUST be tired! I've slept 14 hours only since Friday and you've been on here the entire time!

My husband asked me when I plan on doing laundry or dishes. I was worried he might get mad, but he's been patting me on the back and lending moral support. Between all night vigils praying for Terri, pouring through the Bible, calling Senators, DCF, etc... emailing, we are all getting a little burry-eyed. I actually cried this am because I had no sugar for my coffee, and that's not like me! LOL! And I'm still trying to keep up with a webcam and results from a tournament in Denmark my son is in.

I feel the need to pray for strength for everyone who is praying for Terri. Sometimes the spirit is willing, but the flesh is weak. I know mine has been. Can someone offer up a prayer for the thousands who are keeping vigil for Terri to stay strong? I'm not always good with words.

Courts can only issue opinions. They can't enforce them. At least, that's the way it's supposed to be, under the separation of powers our Founders set in place.

As you say, that's the way it's supposed to be.

I'd say it has to do with the DCF employee who would love to blow the whistle on DCF for quashing investigations into Terri's abuse as early as 2003, but would not testify unless under subpoena and protection.

All in all, I'd say if they can expedite matters, it's good news! Or at least an effort!
