The Trump Organization cheated tax authorities for 15 years by bankrolling big perks for top executives — including apartments and luxury cars, Manhattan prosecutors said as the real estate company’s criminal trial got underway Monday.
Former President Donald Trump’s firm used the perks to pay its executives — without reporting those benefits — as part of an alleged scheme to avoid paying taxes between at least 2005 and 2021, Assistant District Attorney Susan Hoffinger said in her opening statements in Manhattan Supreme Court.
“This case is about greed and cheating, cheating on taxes,” Hoffinger told jurors.
“The scheme was conducted, directed and authorized at the highest levels of the accounting department at the company.”
The ex-president’s namesake company benefited from the alleged plot by keeping its “trusted” chief financial officer, Allen Weisselberg, happy and avoiding some taxes, the prosecutor said.

If an employee is paid, in cash or goodies of some kind, that payment to the employee is an expense to the employer and a tax burden to the employee. So if Trump & Co never reported these payments or renderings, they did not take the deduction(s) for same which would result in an OVERpayment of taxes. The whole thing makes little sense. By the way, what happened to the property overvaluation accusation through which Trump was able to borrow more than the properties might have collateralized? All those loans were paid off many years ago. None of the lenders is claiming to have been unpaid. We’re onto something else, now?

The tax law is intentionally complex in that it doles out favors for special interests. The complexity gives the IRS and DOJ many avenues to go after individual taxpayers the federal government wishes to punish. There is no living human being with complete knowledge of the tax code.

In a nutshell, if it’s a C Corp the corporation itself pays taxes on its income and the employees pay taxes on their salaries/compensation. If it’s an S Corp the owners of the corporation pay taxes on the corporation’s income and the employees pay taxes on their salaries/compensation.
