Up until Friday, the Kyle Rittenhouse trial was very clear: Easily understood videos and witness testimony (including testimony from the prosecution witnesses) showed that Kyle, despite trying hard to avoid conflict, was attacked by a crazed child rapist, whom Kyle shot as the rapist was grabbing Kyle’s gun, at which point a mob went after Kyle. He then shot and killed a domestic abuser trying to bash his head in with a skateboard, and shot and wounded a felon aiming a loaded, illegal gun at his head. On Thursday, however, the court allowed prosecutors to enter into evidence a fuzzy photo from a late-produced drone, an image prosecutors argue shows Kyle “provoking” the attacks against him. Provocation destroys Kyle’s assertion that he acted in self-defense.
Andrew Branca explains how well the prosecution did on Friday. The “unicorn” evidence that the prosecutors successfully fought to get admitted is the drone footage that they just coincidentally found at the last minute before the trial. According to the prosecution, an incredibly fuzzy photo that was computer-enhanced (meaning that AI made “educated” guesses about where pixels should go) shows Kyle pointing his gun at Joshua Ziminski, who fired the first shot that saw Rosenbaum, who had earlier threatened to kill Kyle, chase after the boy.
The problem for Kyle is that, under Wisconsin law (as is the case under most states’ laws), a person who provokes an attack may not then claim self-defense. If the jury accepts the drone footage as showing Kyle threatening people with the gun, then it was he who triggered (pun intended) all subsequent events, including his shooting three people. However, Wisconsin law also holds that, even if someone provokes things, if he withdraws from the fight but pursuit continues, he can regain the self-defense privilege.

I think the jury should be able to see how sleazy the prosecutors are. But having been on many juries I have concerns about the logical abilities of many that get through the voir dire process. The legal side with no case tries to eliminate those potential jurors that seem to have logical ability. Usually this is the defense attorney, but this time it is the prosecutor.

The prosecution lied yet again.
The DEMON DEMOCRATS SURE are GREAT at PRODUCING LATE stuff....like this FUZZY DRONE PICTURE AND BALLOTS!
But there is a good shot of Kyle on his butt with the dude aiming his gun right at Kyle and Kyle perceived him as a threat....well duh...
Yesterday there was a discussion as to whether Kyle initiated the violence....but then you hear Kyle was beaten with a skateboard etc etc...It's a stretch...
We have been following and watching. The question the defense never asked and should have asked is “Can individual pixels also be manually edited?”
How many times is the jury going to need to watch that fuzzy drone video clip with the prosecutor's repeated insistence that what they declare is what the jurors should see? The jury already heard the forensic manipulator of the image say he doesn't know what way or how the software program altered the image to get it to the state it is in at this point.
After all of the prosecutor's failures in this case, the jury may realize this is the state's swan song. Through the whole trial, the state didn't present this fuzzy theory until both sides rested their case. I wouldn't buy into it.
Finally, the prosecution describes this occurred after Kyle put down the fire extinguisher. Makes more sense that Kyle was simply adjusting/shifting the rifle and strap after bending over. The state's argument is full of holes.
If the prosecution shows the fuzzy image to the jury in their closing argument, the defense will be able to rebut ‘fuzzy image’ with the clear images of Rosenbaum chasing Rittenhouse.
Additionally, the defense will be able to point to the many witnesses who talked about Rosenbaum’s words and actions prior to the shooting. Rosenbaum was definitely in an aggressive mood that night.
Actually, it probably will be good to have the prosecutor bring up the ‘fuzzy image’ so the defense can make it very clear to the jury that a ‘fuzzy image’ is the best the prosecution has.
I also reached this opinion after initially being annoyed that the judge allowed it in. The image is a Rorschach test presented by a leftist prosecutor.
My concern is that this is a Rorschach test for the jury.
Shown the blur and if you harbored a conclusion before the trial and already made up your mind, you’d take the blur of nothing and hang your hat on it.
“See! That blur shows he pointed a gun and was the aggressor. If they defended themselves after that well it’s still on Kyle for showing up with a high caliber gun to a mostly peaceful protest!”
You don’t want the jury to get that instruction.
The evidence is a blur. Prosecutors lied already and will lie about it more in the closing.
Any jail time for Kyle is likely a death sentence.
Writing at PJ Media, Victoria Taft explains that, in more bad news for Kyle’s defense, the judge allowed the prosecutors to add several lesser charges to the more serious charges already pending against Kyle.This is disastrous for Kyle because it allows the jurors - who are fully aware of the baying mob that will greet them outside the courthouse and follow them to their homes - to assuage their consciences by finding Kyle guilty of the lesser charges.
He’ll still go to prison but not for life. Of course, once in prison, unless he’s kept in solitary, his life will probably be very short.
What happened to Kyle is just one more piece of the leftist politicization of law in America.

The prosecutor now has a chance those on the jury who mentally convicted Kyle just for being there can use this as the basis of their argument to other jurors.
It at least sets up a compromise verdict of a lesser charge which, as I said, is likely a death sentence for Kyle and certainly life plan destroying.
Kyle is the target of the DOJ.
Elites are saying they’ll allow riots when they want them. They’ll prosecute whomever doesn’t align with them politically. They’ll destroy the reputation and jail anyone they choose. Don’t you dare protect your property or community or we will destroy you as well.
Look at Flynn. Look at Bannon. The January 6 protestors. Kyle.
Hopefully, there are reasonable people on the jury who will look at this video and see nothing.....there is nothing there. Sure you could have a well dressed person who seems to a authoritative, tell you what they want you to think is happening, but this is chaos, worthless chaos.
But it could be a seed for certain people who really do want Kyle convicted.....but at the end of the day, this seed isn’t really needed. Those types of folks had their minds made up prior to entering the courtroom, regardless of what they told the court.
