The DOJ said its probe focused on seeing whether federal prosecutors could prove that the officer violated any federal laws. This would seem to be the problem, the fact this occurred in DC. In most any state this would have been a crime, as evidenced by the 2nd Degree Manslaughter charge against the police woman who accidentally shot the hoodlum in MN. DC is ground zero for lawlessness and corruption.

Given the publicly released videos, the barrel of the gun would need to be pointed upwards by about 10 degrees. The barrel of the gun was nearly parallel to the ground when the muzzle flashed. That's with 3 36" doors, the gun centered horizontally within the frame of the 1st door ~62" above the ground, Ashli's shoulder ~72" above the ground ~56" to the right within the frame of the 3rd door.
Possible exceptions: the gunman's super tall and/or Ashli was leaning very far forward bent at the waist. In the latter exception, Ashli would have fallen forward, not backwards.
