No Charges Against Officer Who Shot Ashli Babbitt: DOJ

The U.S. Capitol Police officer who shot dead an Air Force veteran during the tumultuous events on Jan. 6 will not be charged, the Department of Justice (DOJ) announced Wednesday.

The U.S. Attorney’s Office for the District of Columbia and the DOJ’s Civil Rights Division decided jointly not to pursue charges against the officer.

The decision came after a “thorough investigation” into the shooting of Ashli Babbitt, a 35-year-old who joined others in storming the U.S. Capitol in Washington during a joint session of Congress in January. Babbitt was shot while trying to climb through a broken window into the Speaker’s Lobby, adjacent to the House chamber.

“Officials examined video footage posted on social media, statements from the officer involved and other officers and witnesses to the events, physical evidence from the scene of the shooting, and the results of an autopsy,” the DOJ said in a statement.

“Based on that investigation, officials determined that there is insufficient evidence to support a criminal prosecution.”

The officer remains unidentified in the public sphere. A lawyer representing him did not return a voicemail or an email.

Babbitt’s family was informed before the decision was publicly announced.

Terrell Roberts, an attorney for the family, told The Epoch Times that the decision was “baffling.”

“I find it to be baffling given the circumstances that it’s a clear case of shooting unarmed person without any legal justification, but I have no idea what went into their decision,” Roberts said.

The family plans to move forward with a lawsuit against the officer for an excessive use of force.

Babbitt’s death was caused by the gunshot, which hit her left shoulder, the District of Columbia Office of the Chief Medical Examiner ruled last week. The manner of death was homicide.

The DOJ said its probe focused on seeing whether federal prosecutors could prove that the officer violated any federal laws.

“The investigation revealed no evidence to establish beyond a reasonable doubt that the officer willfully committed a violation of 18 U.S.C. § 242,” it said.

“Specifically, the investigation revealed no evidence to establish that, at the time the officer fired a single shot at Ms. Babbitt, the officer did not reasonably believe that it was necessary to do so in self-defense or in defense of the Members of Congress and others evacuating the House Chamber. Acknowledging the tragic loss of life and offering condolences to Ms. Babbitt’s family, the U.S. Attorney’s Office and U.S. Department of Justice have therefore closed the investigation into this matter.”

Well, gee. 3 thoughts.

1. We ought to riot in the streets,
2. It wouldn’t take too long to figure out who the shooter was if someone with keen investigative abilities took the time,
3. For this debacle, there is one person ultimately responsible and deserved of extreme prejudice (no, it ain’t at 1600 PA).

Given the publicly released videos, the barrel of the gun would need to be pointed upwards by about 10 degrees. The barrel of the gun was nearly parallel to the ground when the muzzle flashed. That's with 3 36" doors, the gun centered horizontally within the frame of the 1st door ~62" above the ground, Ashli's shoulder ~72" above the ground ~56" to the right within the frame of the 3rd door.

Possible exceptions: the gunman's super tall and/or Ashli was leaning very far forward bent at the waist. In the latter exception, Ashli would have fallen forward, not backwards.

You are over analyzing it without direct evidence. She was shot. She wasnt armed. She was not a threat. DC and the capitol in particular seem to only be governed by federal statute, which apparently says its not against the law to shoot a civilian in the capitol. No reasonable prosecutor would indict...

Maybe you are looking for the grassy knoll...

Arm chair detectives and conspiracy theorist here on FR do not have forensic evidence and videos dont always show all the perspectives. From 10 feet away, an unsteady hand on a short barreled pistol can pull a shot from a few inches to a few feet off center and it can happen in the fraction of a second it takes to pull the trigger.

Barrel flipped up after the muzzle flash. Prior to the flash the barrel was virtually parallel to the ground.

Did you review the video frame by frame? Did you perform a depth projection relying on the structural geometry in the area? Unlikely you have the tools, time, nor knowledge to do so.

Did you at least notice the 3rd door window pane being easily pushed in, and Ashli being signaled to enter?

The reported facts are inconsistent with the content of the videos. By characterizing that as conspiratorial nonsense says more about your commitment to convenience than having the willingness to analyze the details.

Regarding the conspiracy ridicule, that’s an impressive skill you have there. Unfortunately, I don’t have a conspiracy angle to provide you — with the possible exception the facts are not being disclosed. But if you’re a believer in the “siege”, you’re obviously not alone.

I once shared the outrage regarding the Ashli situation. I called her a hero, and was astonished the gunman fired upon her while LEOs were standing directly behind her. But then the videos were made public that raised questions... or “conspiracies” as you call it.

Well I had to ask because you seemed like you were driving somewhere but would not state where.

I have been defensive shooting and instructing far too long to not recognize muzzle flip when I see it.

I share outrage at the shooting of Ashli and of the lack of transparency in the investigation as well as the almost predictable outcome.

Having said that, in watching the video, Ashli made some very poor judgement errors that day. She is seen surrounded by clearly violent individuals who are threateningly taunting capitol police, and vandalizing and breaking down doors/windows. She is an active participant in the verbal taunting and aggressive, ‘in your face’, yelling at capitol police. At points she even acts ‘triggered’.

Did she deserve to be shot for that? No. And there were very questionable actions by the capitol police as well as the shooter. The police were guarding doors and then they seemed to retreat. Why? This allowed the more violent in the crowd to continue breaking down the windows and barriers, providing the shooter an ‘excuse’ to shoot Ashli, or anyone who happened to be in the line of fire.

At the time of the shot, was Ashli any more a threat than before that to the shooter? It doesnt appear so. So if this was going to court, I would be inclined to press why the shooter fired when he did and not sooner if he felt threatened, or why not not wait until the doors had actually been breached. I would also ask why the door guards cleared out when they did as this seemed to signal a ‘go-ahead’ to those individuals busting up the doors/windows.

I dont have answers, but I dont think it helps at all presenting tin foil notions that the (only) shot fired could not have hit Ms Babbitt where it did. This is a conservative web site. I’d like to think its not Art Bell.
