Supreme Court rules federal civil rights law protects LGBT workers

Washington — The U.S. Supreme Court ruled Monday that it is illegal for an employer to fire someone because of their sexual orientation or gender identity, delivering a major victory in the fight for civil rights for LGBT people.

The court's 6-3 ruling extends the scope of Title VII of the Civil Rights Act, which bars discrimination on the basis of sex, race, color, national origin and religion, to include LGBT people. Chief Justice John Roberts and Justice Neil Gorsuch, who authored the majority's opinion, joined the liberal wing of the bench in ruling that "an employer who fires an individual merely for being gay or transgender violates Title VII."

Title VII only applies if the employer has more than 15 employees. Of course, local and state laws may vary from that. In Florida, the state civil rights act is the same - 15 employees. Not that this is any real comfort, but it is good to know if you have a small business.

That would no doubt result in a discrimination lawsuit as well, awarding the “victim” $25 million or so.

Major decision. Gorsuch and Roberts use faux textualism to achieve the result they desire. The usual four leftists join in the charade.


But but but “Trump judges” will save us!

Counting “Trump judge” chickens was always a fools errand given the ideological unreliability of GOP nominees historically. I didn’t expect such a major back stab from Gorsuch so soon but here we are.

Major cases usually are decided in June, because it’s the end of term. As there are no decisions from July until the winter, there are a higher number of decisions in June.

I think it means they rotate votes. Kavanaugh sat this one out and will take one for Team Uniparty later. We’re being played like a fiddle here.

I agree we should repeal Title VII. It is devastatingly expensive to employers and state and local agencies, which are spending a lot of time and resources on both prevention and litigation. I practice employment defense. Too many cases are shake-down operations but the ‘civil rights’ attorneys know that they will get fees if they win or settle, and defense attorneys will not get fees nor most of the costs back for their clients if the defense wins. Civil rights lawyers also know the cost of discovery and trial, so every case filed has big potential for settlement regardless of merit.

I don't intend to change. I may have to adapt by going underground.

Right now we must continue to recognize the difference between right and wrong and proclaim the difference.

When it reaches the point speaking the truth in public endangers my grand kids, then I'll go underground.

What's interesting is that many Catholic schools wouldn't even qualify as "religious institutions" by objective legal measures.

Catholic Charities lost a landmark case in California years ago for this very reason. The state court determined -- and rightly so, in my opinion -- that Catholic Charities is NOT a religious organization.

Corporations want social issues “settled” in favor of the progressive agenda. They are getting what they paid for from our bought and paid for institutions. Congress, courts, etc. Corps basically run this country now.
