The House of Representatives filed a motion Tuesday asking a federal court to block the construction of President Donald Trump's signature border wall through funds identified in his emergency declaration before it starts next month.
"Absent this Court's timely intervention, defendants are poised to begin construction on the border wall next month, using funds that Congress declined to appropriate for that purpose," the filing reads. "This Court should therefore issue a preliminary injunction to prevent that irreparable injury to the House."
The Democrat-led House sued earlier this month, arguing that Trump's decision to transfer funds from appropriated accounts to a southern border wall violates the Appropriations Clause of the Constitution. The clause -- found in Article I, Section 8 -- gives Congress power over the designation of federal spending.

Courts are not a high authority in dispute between two branches of government. How could branch three be above the other two branches?
Money has already been appropriated by Congress for national defense. It was just moved to another cost center.

And what does Trump's FBI do? They arrest a US citizen on trumped up weapons charges because he and fellow patriots were detaining Illegal Invaders and calling in border agents.

What else is our wonderful FBI doing? Well, they acted with the speed of light to arrest, charge, and threaten to incarcerate (for 40 years!) a Hollywood actress who greased palms to get her daughter into USC.

The House passed all sorts of stuff passed up to the Senate where it was not taken up because it had no chance of receiving 60 votes. The most glaring example is Obamacare that was passed up I believe 51 or 57 times.
Your anti Republican charges are fashionable but not really true.
The fact is, the Republican House had no more power than the current Democrat House in the face of a Senate with a Republican majority but lacking 60 votes.
