Oregon Sen. Jeff Merkley seeks injunction to delay Brett Kavanaugh Supreme Court vote (not good)
Oregon Live ^

(Merkley)The Oregon Democrat will ask a federal judge Wednesday to issue an injunction to stop Senate Republicans' hurry-up plan to vote on Kavanaugh's nomination. Merkley asserts he's not been given adequate time to do his job of reviewing Kavanaugh's qualifications to serve on the nation's highest court.

Merkley's complaint has more to do with the 100,000 pages of Kavanaugh-related documents withheld by the Trump administration than with complaints of sexual misconduct. Specifically, Merkley accused President Donald Trump and his staff of "imposing a broad and unprecedented blockage on the Senate's and the public's access to reams of key documents that directly bear on Judge Kavanaugh's views, experience and character."

In Kavanaugh's case, the Trump administration has withheld records from his time working as staff secretary for President George W. Bush. The National Archives, which traditionally supervises records releases for Supreme Court nominees, has said it won't have its Kavanaugh records ready for release until late October.

Senate Republicans don't want to wait that long. They argue that Merkley and other Democrats have their minds made up anyway and the release of new documents won't change anything.

Let me guess. He’s petitioning a District Judge sitting within the 9th Circus’ geographical area?

They’ve already been through this and Cruz gave an answer in one of his 5 minute time allotments. They docs in question belong to others and Kavanaugh was merely the conduit the docs had to go through.

“The courts have no jurisdiction. This is a political question”

We have seen a number of clear cases of Judicial overreaches and if this Rat trick works and this delay will absolutely push it past the mid terms.

The courts have no jurisdiction. This is a political question.

Correct. However, as we have seen in the past there is always a willing leftist judge willing to get involved and stop things. They will find one that will issue the injunction. It's "for the team".

“A Clinton or Obama judge could issue an injunction but the Senate would ignore it.”

Not once has an outrages injunction by a federal Judge simply been ignored. If this Judge does it the shit show will continue for months. especially with a 4-4 SC.

Remind me how many hours it was between when the final version of ObaMao Care was released and when it was rushed to a senate vote. I seem to recall 72 or less.

Trump and congress can ignore any, “judge”, as this is separation of powers. It would be interesting to see the SC if senate ignored the 4, and confirmed Kavanaugh

Any Judge who does that is just begging to be impeached.

You are an ignorant and scared fool. People like you should read and not post because your idiocy is so evident. You have been told by dozens of posters that you are wrong and you persist in your pathetic whining.

You then post to me a completely embarrassing comment about a presidential exec order like it is the same thing as a legislative process in Congress. You revealed your massive ignorance, idiocy, confusion and fear in just a few words. When I read your post, I remember thinking, "Wow, this guy is clueless and has no idea how stupid he is." Get a civics book and educate your ignorant mind.

No court has jurisdiction over the Senate.

An injunction can be ignred with disdain.

The FBI can arrest the judge for obstruction of governance and conspiracy to commit sedition

See the Constitution. There is no argument.

Since when does the constitution stop liberals? Did it stop DACA, no. I don't know how this will play out, but This is idea that a liberal judge wouldn't ever be bold enough to try to use a lawsuit to tell congress to delay the vote is naive, at best.

also the idea that turtle McConnell would defy such an order instead of hiding in his shell like he usually does, is also naive, at best.

I am exactly right. Nothing will come of this idiocy and MM definitely would ignore any adverse ruling.

It is unfortunate when hatred gets in the way of accurate observation.

I hope nothing does come if it, but it remains to be seen.

However the idea that a liberal judge would NEVER try to do anything unconstitutional and that Mitch McConnell is a brave titan who fears nothing, and would defy a court order in second, is ridiculously ignorant of history.

“See the Constitution. There is no argument.”

Refer to the writings of William Rehnquist, former Chief Justice of the Supreme Court on the topic.

I think he was just a bit more informed on the subject than you are.

After you have demolished his arguments, get back to me.
