Oregon Sen. Jeff Merkley seeks injunction to delay Brett Kavanaugh Supreme Court vote (not good)

(Merkley)The Oregon Democrat will ask a federal judge Wednesday to issue an injunction to stop Senate Republicans' hurry-up plan to vote on Kavanaugh's nomination. Merkley asserts he's not been given adequate time to do his job of reviewing Kavanaugh's qualifications to serve on the nation's highest court.

Merkley's complaint has more to do with the 100,000 pages of Kavanaugh-related documents withheld by the Trump administration than with complaints of sexual misconduct. Specifically, Merkley accused President Donald Trump and his staff of "imposing a broad and unprecedented blockage on the Senate's and the public's access to reams of key documents that directly bear on Judge Kavanaugh's views, experience and character."

In Kavanaugh's case, the Trump administration has withheld records from his time working as staff secretary for President George W. Bush. The National Archives, which traditionally supervises records releases for Supreme Court nominees, has said it won't have its Kavanaugh records ready for release until late October.

Senate Republicans don't want to wait that long. They argue that Merkley and other Democrats have their minds made up anyway and the release of new documents won't change anything.

Correct me if I am wrong, but it sounds like a federal Obama appointee could rule that the kavanaugh vote will be postponed until these documents are dispersed to senators and they have time to read them. (meaning as long as this judge wants)

Please tell me I am wrong.

The courts have no jurisdiction. This is a political question.

Clear separation of powers issue and this is a Constitutional obligation of the Senate. a judge has no jurisdiction here and should actually be impeached if she interferes.

I don’t think a judge can tell The Senate what it can or can’t do....

but of course who knows...if this judge approves it may end up on the 9th circus

and go to the Supreme Court....a 4-4 tie would mean the 9th circus will be the rule

The Executive branch may give deference to psychotic Democrat judges, but the Legislative will not.

Imagine a wacko judge telling U.S. Senators what to do, LOL!

I actually think the Senate might ignore this if it ever got to that point. A Judge cannot tell the Senate not to vote.

Supreme Court would shoot it down - unanimously - before that point anyway. Even the four liberal justices.

How many dozen hours did Kavanaugh sit and answer questions over 3 months? How many tens of thousands of questions did he provide written answers to? How many opportunities were presented to look into Kavanaugh when Kavanaugh was mentioned by Romney in 2012?

if Sen Merkley is that slow a reader, if six years isn’t enough, maybe he should be a sloth caretaker at the zoo instead of a senator.

Merkley should be censured for wasting the court’s time and making a mockery of the separation of powers.

These idiot Leftists never stop to consider the precedents their little stunts are setting. Do they really want Federal courts overruling Senate leadership from now on? Do they really want every Supreme Court nominee’s high school behavior closely scrutinized from now on?

A Clinton or Obama judge could issue an injunction but the Senate would ignore it.

Its the separation of powers and one branch can’t tell the other branch what to do.

This is going nowhere.
