U.S. Attorney General Loretta Lynch is looking into options to challenge a Supreme Court ruling that effectively determined a lower courts decision neutering President Obamas executive amnesty would stand. The ruling would help to prevent Obama from ignoring U.S. laws and from allowing many illegal aliens to stay in the U.S. without deportation.
The statements from Attorney General Lynch were made during an interview with Reuters. The Reuters writer appears to have confused the ruling, as SCOTUS did not make the decision to block President Obamas executive amnesty, they simply tied in their decisionwhich led to the Fifth Circuits ruling being left in place.
The Obama administration is looking into whether it can challenge the Supreme Courts decision to block President Barack Obamas plan to spare millions of illegal immigrants from deportation, U.S. Attorney General Loretta Lynch said Tuesday.
We will be reviewing the case and seeing what, if anything else, we need to do in court, Lynch told Reuters in an interview.
Breitbart Texas legal analyst, Lana Shadwick, discussed the ruling in a recent article. She wrote:
The executive amnesty order issued was stalled by a 4-4 vote in United States v. Texas, et al. leaving the U.S. Court of Appeals for the Fifth Circuits ruling. When a decision is tied, it leaves the lower court decision in place. The next presidents appointment of a new Supreme Court justice could tip the balance in favor of allowing a president to bypass Congress and implement his or her own immigration law.
As reported by Breitbart Texas, the Fifth Circuit issued a ruling in November 2015 effectively putting the brakes on President Obamas November 2014 executive amnesty order.

What this actually says is that he is about to declare the Supreme Court’s authority invalid.
Which, oddly enough, would be a marvelous precedent. Get SCOTUS out of abortion, out of the definition of marriage, out of affirmative action, out of Obamacare, out of Christianity in the public schools...put it back where it belongs, as the co-equal branch, not the more-equal branch. Obama, be careful what you wish for.
No kidding. There is no other way to “challenge a Supreme Court ruling” than by passing a law (and sometimes that won’t work). Here, Obama was to have exceeded his authority to “interpret” a law via Executive Order; had Congress been willing to pass a law on immigration more to his liking, no E.O. would have been necessary. There can only be one conclusion here as to what he is planning.
Options to “Look Into”:
1) Comply with SCOTUS ruling immediately.
2) Constitutional Crisis that should be resolved by impeachment, but will not because of Congressional division and fecklessness.
3) Posture, say nothing definitive, keep doing what Obama’s been doing since there’s nothing to stop him.
It wouldn’t be marvelous. It would set the precedent (unconstitutionally at that) that the executive branch could challenge the judiciary, the only branch in the federal government that has the constitutionally delegated authority to decide if a law is within the bounds of the constitution and bill of rights. (I’m not capitalizing them anymore because all it takes is a phone call and the stroke of a pen to eliminate both. Don’t think it can be done? A not-natural-born citizen has been president for 7 1/2 years.)
Oh, yeah, what a marvelous idea...you would also get the Court out of gun control, privacy, Due Process, etc. You would give ultimate authority to any administration that could run over Congress.

Well technically the Supreme Court made no ruling to declare invalid, they simply took no action and allowed the 5th circuit injunction against Obama's executive amnesty to stand. However there have been rumors that the Obama Justice Department may try to say since the Supreme Court didn't take a position the 5th circuit injunction only applies in the 5th circuit and not to the rest of the United States and they would then move forward with implementing executive amnesty in the rest of the country outside the jurisdiction of the 5th circuit. This would be a major slap in the face the federal judiciary as it is considered customary to respect an injunction nationally until it is resolved by the federal circuit court.
After all, why should the Just us Department (which works for the president) be expected to read and follow the Constitution of the United States? I mean, the prez was a constitutional scholar and knows soooo much more than the old white guys that wrote the document.

Why be concerned with the court? The final check on the president is impeachment. Ryan won’t go there so obama can do whatever he wants. The key for obama is to do things that can’t easily be undone, not to do things the court is ok with.

Yes it would, for a DEMOCRAT president. The moment a Republican president attempts to do something like this the Dems in congress will shut it down in a New York minute, with the full cooperation of sympathetic Republicans.
We could follow suit with the Executive Branch.
We still have a long way to go until that bastard is supposed to leave office, if he does. The damage that he and the members of his administration , each of who hate America as much or more than he does cannot be imagined. American haters are not limited to the Democrat Party. As Donald Trump has clearly shown, the Republican Party has more than their share of American haters also. So , tighten up your belts, it is going to be a rough ride ahead.
