Former governor Jeb Bush said that Kim Davis, a Kentucky county clerk jailed for contempt of court after refusing to issue marriage licenses to same-sex couples, doesnt have the authority to defy the courts.
She is sworn to uphold the law, and it seems to me that there ought to be common ground, there ought to be big enough space for her to act on her conscience and now that the law is the law of the land for a gay couple to be married in whatever jurisdiction that is, Bush told reporters in New Hampshire.
Daviss case and Bushs response are emblematic of a tactical question that has divided Christian conservatives since the Supreme Court invalidated traditional-marriage laws, with some activists adopting a posture of limited acquiescence and others calling for outright defiance of the judiciary.
With the presidential primary season under way, its a debate that could affect the allegiances of the social conservatives who tend to dominate the Iowa Republican caucuses. Davis, in an attempt to resist the Supreme Courts ruling while avoiding accusations of discrimination, is refusing to issue marriage licenses to anyone in Rowan County, Ky., and she is refusing to allow her assistants to do so as well.
The court cannot condone the willful disobedience of its lawfully issued order, U.S. District Court Judge David L. Bunning said. If you give people the opportunity to choose which orders they follow, thats what potentially causes problems.
Senator Ted Cruz, whose presidential prospects depend largely on attracting the evangelical voters who propelled George W. Bush to victory in 2000 and 2004, issued a stentorian endorsement of Davis. We are a country founded on Judeo-Christian values, founded by those fleeing religious oppression, and seeking a land where we could worship God and live according to our faith, without being imprisoned for doing so, he said Thursday. I call upon every believer, every Constitutionalist, every lover of liberty to stand with Kim Davis.
Stop the persecution now. Former Governor Mike Huckabee, who won the 2008 Iowa caucuses, was similarly strident. Kim Davis in federal custody removes all doubts about the criminalization of Christianity in this country, he tweeted.
Bush refused to endorse such characterizations of the case: As I said, I think a big, tolerant country ought to be able to forge a consensus. This doesnt have to be all resolved in Washington. This ought to be resolved at the local level where you find common ground, where a person, clearly based on her religious convictions, should be able to act on her conscience and have people not be discriminated against.
Bush has the political misfortune of using the same rhetoric that Hillary Clinton and Democratic proponents of gay marriage are using to denounce Davis. Thats a mainstream, though hardly unanimous, attitude among social conservatives. A religious accommodation, like religious liberty in general, is not absolute, the Heritage Foundations Ryan Anderson, one of the most prominent traditional-marriage advocates, wrote Thursday. There are ways in which public policy can create a win-win situation: where all eligible couples can receive a license and where as many employees as possible can be accommodated. And yet, Bush has the political misfortune of using the same rhetoric that Hillary Clinton and Democratic proponents of gay marriage are using to denounce Davis. Marriage equality is the law of the land, Clinton tweeted. Officials should be held to their duty to uphold the law end of story.

No, Bush, there is no common ground when one side relentlessly drives their agenda and the other side has a spine of Linguini.
Sit down and shut up!
Not sneaking into the US is the law of the land, but I don’t see the officials running sanctuary cities going to jail, or the border jumpers. The left is really showing their power here by blatantly, openly not enforcing laws when they don’t want to, but cracking down on Christians business owners and officials who haven’t actually broken laws, just committed “thought crimes”.
So. Were Jebito’s remarks actually in Spanish and translated here for all us selfish English-only speakers?
Gee - Jeb speaks out harsher to a public servant than he does the President, the DOJ, the criminal illegals (how about they follow the law Jeb?) and the sanctuary cities that flaunt the law.....
So did the justices of the Supreme Court but it did not make any difference.
“She is sworn to uphold the law”
Presidents are sworn to uphold the law. Youre running for President, but have plans to ignore our immigration laws.
Misfortune? Not really. It's just another talking point prepared by their corporate handlers for both Dems and the GOP establishment.
yep faith is over man’s laws ..go ahead america keep kicking God in the teeth, the only reason America formed was to spread Christianity to the world, in that mission we prospered..we now see the other direction..
...So is Lois Learner and Eric Holder...but it doesn't seem to matter. Only conservatives go to jail. Liberals take the fifth or just ignore the law,
America can rot in its immoral “so called truths”, God needs to break the world system to fix it with Christ as King.
He has said many times, mostly old testament, If a temple is built do not cut it,don’t do anything to the rocks, he says nothing man does is good to Him.
This is a call for the faithful to follow Him and leave our understanding, the flock does get moved to better pastures if we follow..
Peace in the only path to God, the risen Lord Jesus!!
“now that the law is the law of the land”
It is NOT the law of the land. Show me where it has been passed by the United States Congress and signed into law by a President.
It hasn’t been! Judges do not make laws!
cheb is not real clear on this law thing,.... is he!
I see an early retirement in his near term future
Hey Gayster Jeb Bush ?
Many states held election that banned gay marriage and had rouge judges strike down those gay marriage bans, those were legally held elections.

Well a willfull interpretation as a tool for political power by the courts is not out hustling...it is out-dis-honesting.
The potential remedies are political though and does require some hustling:
1) Make dishonesty socially shameful and keep it shameful
2) Shame universities out of having pro minority bigotry departments that blame everything on white privilege and other such divisive crap.
3) Stop being so polite to obnoxious left wing relatives on facebook or coworkers that think that being entitled to a point of view entitles their point of view to be taken seriously and not feel mocked and shamed for having a ridiculous and narrow point of view.
4) Make people socially afraid of being saying stupid things, rather than socially afraid of saying anti-left things.
Jeb Bush who is a crook. he made millions the easy way by taking bribes.
>> Exactly right, Jeb <<
Nope. Exactly wrong, Jeb. States no more have the "right" to redefine marriage than they do to redefine the law of gravity. Marriage is marriage and it doesn't change, regardless of what ANY government jurisdiction says about it. Likewise, carrots would remain a vegetable whether the federal government OR Rhode Island government decided they should now be classified as "meat" and ordered grocery stores in Warwick, RI to sell carrots in the meat section of the store. Simple biological facts don't change and no government has the power to make them change.
Exactly right.
If some court rules that up is down and down is up, and you go jump off an eighty-foot cliff, the rocks at the bottom won’t care in the least about how wicked some judge was, or how stupid you were to listen to them.
