Two more GOP presidential candidates have chimed in on the issue of whether Rowan County clerk Kim Davis must provide marriage licenses for same-sex couples.
While three candidates have publicly supported Davis' right to only provide marriage licenses for man-woman couples, three others have said she must do so or resign.
This morning, Wisconsin Gov. Scott Walker told Laura Ingraham, "In the end, this is the balance that you gotta have to have in America, between the laws that are out there, but ultimately ensuring that the Constitution is upheld. I read that the Constitution is very clear that people have freedom of religion -- you have the freedom to practice religious beliefs out there, it's a fundamental right."
Walker also said that he believes the Supreme Court erred in redefining marriage. That decision has led to Davis' circumstances, which include being in court today to face charges of contempt of court.
Yesterday, Louisiana Gov. Bobby Jindal, a trailing GOP presidential candidate, told Huffington Post that Davis was in the right. "I don't think anyone should have to choose between following their conscience and religious beliefs and giving up their job and facing financial sanctions," said the Catholic politician.
"I think it's wrong to force Christian individuals or business owners. We are seeing government today discriminate against whether it's clerks, florists, musicians or others. I think that's wrong. I think you should be able to keep your job and follow your conscience," he said. "I absolutely do believe people have a First Amendment right, a constitutional right. I don't think the court can take that away."
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof;...As far as I can tell, by the wording of the first, her constitutional rights haven't been violated...Congress didn't make any laws restricting her rights. Nor did Congress force her to issue licenses.
Ah, good point. So this is akin to the mayor of SF not enforcing immigration laws, right?
Please have a look at my 11, I think you might be giving Walker credit he does not deserve. I can't make any sense out of his comment.
I'm sorry, but you apparently haven't been paying attention. We now live under a COMPLETELY lawless oligarchy. What makes you think they're going to honor any law that Congress, the people, or any states pass?
After all, Congress properly passed, and the president properly signed, DOMA into law. Look at how much good that did.
Walker is affirming the First Amendment right of citizens to exercise their religion.
There are currently no laws in Kentucky governing the issuance of a marriage license. The Supreme Court stuck down all the marriage license laws in Kentucky. How can she issue a marriage license then there are no laws governing it?
And Walker is correct on that.
So is he backing the clerk like the tittle says?
Excellent point. It is lawlessness for her to issue any license to anyone.
No, immigration laws are federal laws. State and local authorities can not be made to enforce them for the feds. They can't hinder federal authorities in enforcing them, but they can't be told to arrest illegals for them.
She is elected...you can’t fire her
100% correct.
It is now time for ACTION.
Well how is ANYONE getting married then? Is she refusing to sign non-homosexual licenses on the same grounds?
Now it is a matter of when, not if, pastors are jailed for refusing to marry deviants.
Yes she is not signing any marriage license. No marriage license for homosexuals, no marriage license for heterosexuals and no marriage license for transexuals. Nobody gets a marriage license in her county.
Is this “lip service” from Walker and Jindal or will they actually intervene in some way to show solidarity with what they SAY on behalf of Kim Davis.
actually kind of clever. She is not discriminating.
Marriage licenses are issued by the state; county clerks process them as a convenience. You can get a Kentucky marriage license in any county and go to any other county and get married.
Ok, well, that’s fair.
What type of laws should they enact (I’m learning all this as I go.) Maybe this is something we should look into.
