Sotomayor, Kagan: Hobby Lobby Should Drop Insurance, Pay Penalty and Let Employees Use Exchange

During oral arguments in the U.S. Supreme Court on Tuesday which focused on whether the contraceptive mandate in the Affordable Care Act violates the free exercise of religion, Justices Sonia Sotomayor and Elena Kagan suggested employers who have moral objections to birth control should not provide health care coverage for their employees

Chief Justice Roberts interjected that this was in opposition to what Hobby Lobby presented in its lawsuit. “I thought – I thought that part of the religious commitment of the owners was to provide health care for its employees,” Roberts said and Clements agreed. “Well, if they want to do that, they can just pay a greater salary and let the employees go in on the exchange,” Sotomayor said. The court seemed divided along ideological lines

The conflict of 1775-1783 was a civil war.

Didn’t our heroic GOP Senators vote to approve both Kagan and Sotomayor?

All of that could have been avoided if the Dear Leader was NOT in office to sign the ACA or he would repeal it.

"Reminds me of meetings where I have to ‘guide’ everyone back on track. And it just irritates the heck out of me."

ROFL! It reminds me of a recent family meeting in which an important decision had to be made. Within ONE MINUTE people were cross talking and nothing regarding the reason we were there was being discussed. I had to gently guide the people back to the topic at hand.

I meant to say “abortion pills”.

Still, Kagan thinks Hobby Lobby paying a “Fluke” more pay so she can buy the morning after pill isn’t the same as Hobby Lobby outright paying for it. Pure idiots along with those who voted for the person who put her in.

You must have a different way of defining it then - because I don’t recall any effort to take over England.

Single payer is one facet of total government dependence, total government control.

Hobby Lobby Should Drop Insurance, Pay Penalty and Let Employees Use Exchange

That's been their goal all along, IMO.

"Yup. Condomdepot.com generally has good-quality condoms, at less than $.50 each, especially once you start buying in low bulk. Not difficult. At all.

Even if it's a few bucks a clip. If you cant come up with 5 dollars, having sex probably should not be your number one priority in life. This is absurd.

I think that liberal believe that nothing a person does is their fault. Insurance covers addictions and mental health issues which now includes any avoidance a person has to control and be responsible for their own emotions, actions and life choices. If they have sex that has to be covered as an act that is out of a person’s control.

Why can’t women pay for their own damned birth control? Is it that expensive that it has to be covered by “health insurance” that is priced higher because of it.

Members of the Supreme Court can say anything and rule anyway they want (By justifying rulings out of thin air or more accurately "shadows").

The power the *FEW* Supreme Court members have is one of the fundamental flaws in the US Constitution. BTW, conviction of impeachment is virtually impossible with high "valued" positions of government.

In this case, my guess the pro-ACA Justices will find all kinds of shadows in the Employment Division v. Smith ruling while Scalia argues in vain (In which he wrote for the majority in that case).

What are you on about?

Are you suggesting that Hobby Lobby wants to prevent their employers from using their salaries as they see fit?

Cause that isn't the argument being made here.

If I buy a bottle of whiskey with my paycheck, that is not the same as my employer buying me a bottle of whiskey.

I’m sorry....I was totally unaware that it is the job of SCOTUS to find ‘workarounds’ for crappy legislation. Leave it to the Wise Latina and her friend Butch to turn SCOTUS into nothing more than a higher level of mediation. Did they ask Hobby Lobby and the Obama administration to kiss and make up, too?

The “tax” will remain the same regardless of the outcome of this case. The issue is the mandate to supply certain healthcare services which Hobby Lobby opposes on religious grounds. That mandate is not a tax.

$4 per month at walmart.

But again, this isn’t about birth control, that’s just what the left wants to make you believe by conflating birth control with abortion.

The left has been calling abortion birth control. Using words and definitions is one of their best weapons.
Like “global warming” has been changed to “climate change”.
When a liberal says “pro-choice” to me and I say, “you mean pro-abortion?” it will drive them insane. When they say “undocumented workers” and I say “you mean illegal aliens?” same thing.

They’ve been manipulating words to deceive people since their ideological father started the whole thing in Genesis 3.

"The court seemed divided along ideological lines, with liberal judges – including President Barack Obama’s appointed judges Kagan and Sotomayor – emphasizing the rights of employees to have free birth control as mandated by the law, while others focused on government infringement on religious liberty."

What?

The Constitution's "Bill of Rights" sets out "the law" which structures and limits government power and leaves "the People's" freedom of speech, of the press, and of free exercise of religious belief outside the purview of government.

That is "the law" which every President and elected official swears to uphold.

What the writer here calls "rights" to free birth control that are "mandated by law," are simply ill-conceived and artificially described rights which have nothing to do with the "endowed by their Creator" rights laid out in the Declaration of Independence.

Apples and oranges.

The court isn't there to decide solutions, only to rule on the legal aspects.

That concept died about the same time that forced busing came on the scene.
