FORT MEADE, Md. -- A military court was set to hear the case Tuesday of an Army doctor charged with refusing to deploy to Afghanistan because he says he doubts whether President Barack Obama was born in the U.S. and therefore questions his eligibility to be commander in chief.
Lt. Col. Terrence Lakin, an 18-year Army veteran from Greeley, disobeyed orders to report earlier this year to Fort Campbell in Kentucky to prepare for deployment, saying he believed the orders were illegal.
In videos posted on YouTube, Lakin aligned himself with so-called "birthers" who question whether Obama is a natural-born citizen as the U.S. Constitution requires for presidents.
Lakin said in the videos that any reasonable person looking at available evidence would have questions about Obama's eligibility to be president and that he had "no choice" but to disobey orders. Lakin said he would "gladly deploy" if Obama's original birth certificate were released and proved authentic.

Begging the Question Logical Fallacy
The question is did Lakin refuse to disobey the lawful orders of three superior officers. Why he did it isn't important.
Why he did it is because he thinks the orders might be illegal. To disallow the "why" argument is to disallow his defense, questioning the legality of the orders.
Also, to disallow the "why" is a result of Begging the Question, assuming the orders are legal.
I doubt it..

OK, so he was free to produce any evidence supporting his claim that the orders of Colonel Robert, Colonel McHugh, and Lieutenant Colonel Judd were illegal. But Obama is irrelevant to that.

Why would the orders of these three superior officers not be?
And why were the orders of Colonel Roberts, Colonel McHugh, and Lieutenant Colonel Judd unlawful?

I know that and would say that his actual birth certificate is absolute proof that he is not eligible, the COLB is and has always been an abstract copy which does not meet the burden of proof.
Lakin's fall is of his own making. I neither mourn it or celebrate it. But at the end of the day I have no more sympathy for him than I do for Ehren Watada or Yolanda Huet-Vaughn or Michael New or anyone else who feels that they can pick and choose what lawful orders they will follow.

And even if Colonel Lind had allowed it, how would it have exonerated Lakin from refusing to obey the lawful orders of three of his superior officers? It's a simple question to answer. Have at it.
