Breaking: Militia group (Hutaree) charged with "seditious conspiracy" by FBI

In a press release just handed to Fox by the FBI, the six Michigan residents, two from Ohio, one from Indiana are charged with “seditious conspiracy.”

Reportedly, Hutaree is accused of attempted use of weapons of mass destruction. Charges range from August 2008 to today.

The militia group Hutaree are said to have conspired to oppose by force the authority of the US Government.

The members viewed local, state and federal law enforcement as "the brotherhood," also known as their enemy, and have been preparing, the FBI says, to engage them in armed conflict.

According to one plan released by the FBI, the group was to kill a law enforcement officer, then during the funeral precession, hit again with IEDs to kill more LEOs.

The point is with all the domestic Muslim terrorists & groups in this country dedicated to overthrowing it in favor of Sharia - why haven't any of them been charged with "seditious conspiracy?"

Hutaree also threatened Obama, and the Secret Service intervened. The pipe bombs and NFA weapons were investigated by BATFE. FBI took lead on the investigation when it was found out to be a larger conspiracy by BATFE.

the FBI ought to release solid information about the charges involved up-front.

I'm guessing the 'plan' was dreamed up by the ever-present FBI infiltrators and not enough people protested loudly enough. I wonder if they have the same percentage of fed agent infiltration as the SPLC's KKK Klown network. We should be hearing an announcement and fund raising effort from the SPLC/DHS soon.

There has to be a back story that is missing from the indictment. Either these guys are just looking to start trouble, or some local cop (or enough of the department) pissed somebody off in a serious way. The indicment reads like the Hutaree used Charlies Manson logic, kill some people to start a race war; in this case, start a government v. people shooting war.

Teaching the use of explosive materials is only a crime under federal law if the teacher intends that “the teaching, demonstration, or information be used for, or in furtherance of, an activity that constitutes a Federal crime of violence” or if the teacher knows that the student intends to use it for such a purpose.

A “crime of violence” is “(a) an offense that has as an element the use, attempted use, or threatened use of physical force against the person or prop erty of another, or (b) any other offense that is a felony and that, by its nature, involves a substantial risk that physical force against the person or property of another may be used in the course of committing the offense.”

“Seditious conspiracy” is conspiracy “to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof”.

Basically, in order to make any of this stick, the prosecution will have to prove that these people were planning to commit some actual act of violence. Now, it certainly isn’t above a U.S. Attorney to go on a witch hunt, but they tend not to prosecute crimes they can’t get a conviction on - their conviction rate is much higher than most state DA’s offices for a reason.

We don’t really know what’s going on here yet.

Why would anyone target LEO? Just guys doing a job.
And how does targeting local LEOs challenge the authority of the Federal Government?

If you are really going to go to the trouble of actually planning something, you do not kill a snake by chopping of the tail.

In grad school back in the 70s I had a brilliant Jesuit prof at Fordham raise the danger of the language in the seditious conspiracy law. It could include anyone from anti war protesters to organized crime and anything in between. The phrase "oppose the authority of the govt of the U.S." is a catchall.

I do not believe the law has been used in my lifetime.It was not used against the Chicago 8, the Berrigan brothers, Code Pink,the Gambino crime family, or any group I know of. It has never been used in the jihadi prosecutions, like the 5 from Buffalo or the recently planned subway bombings by US citizens. To be used now, in this case may be a warning. Today a militia group (not exactly a popular group). Tomorrow the Tea Party itself.

As far as I know, there are no sedition laws in this country. That was settled back during the presidency of John Adams. Just sayin...

All I ask is details. What did they do so that you know that you know that this isn’t simply one man’s interpretation versus another’s.

I'm with you. I want to see facts. Right now what I've heard on the radio is pretty damning, but the timing of this is very suspicious. All of a sudden there is this huge threat from right wing fanatics that say their Christians?

I can't help but wonder if this helps swing the independents back to their socialist masters who are so genteel.
