Illegals-law challenge rejected By Seth McLaughlin December 1, 2007 Virginia Attorney General Robert F. McDonnell -------------------------------------------------------------------------------- A federal judge yesterday threw out a lawsuit challenging the constitutionality of Prince William County's [Va.] new ordinance denying services to illegal aliens. Judge James C. Cacheris said during a brief hearing at U.S. District Court in Alexandria that the plaintiffs lacked standing to challenge the resolution passed earlier this year by the Prince William Board of County Supervisors. Judge Cacheris said he will issue a written ruling at a later time detailing his decision. The Puerto Rican Legal Defense and Education Fund filed the lawsuit last month on behalf of plaintiffs who included illegal aliens and the Woodbridge Workers Committee, an organization of day laborers in Prince William County. But county attorneys argued that the plaintiffs could not demonstrate they had suffered any harm under the measures, which have not been fully implemented. "This is a big win," said Corey Stewart, chairman of the Prince William Board of County Supervisors. "This is the best shot that some of the best litigators in the country can throw at our resolution against illegal immigration. I think that is very telling." Mr. Stewart, a Republican, said the decision would encourage other localities to follow Prince William"s lead. "We think this will give hope to communities all across the country that there is something legally defensible that a locality can do to crack down on the effects of illegal immigration," Mr. Stewart said. "I think that communities all across the commonwealth are going to adopt similar resolutions cracking down on illegal immigration. And I don"t think it stops at the Virginia border. You are going to see localities across the nation adopting similar resolutions."

Rulings made declaring no legal standing, seem open to review when a party with standing does comes along. Was this judge saying no illegal immigrant could have standing in this case? Sounds like it. That doesn’t sound valid to me.

I would have liked a ruling saying the city took appropriate action, despite valid standing by the plantifs.

Still, good news is good news. I just hope it stands up over time.

Much as I would like to say otherwise, I don't think this is a big win. Note the argument above. What happens if a challenger can demonstrate harm? What about when it's fully implemented? What about harm being demonstrated then?

Please, somebody tell me that there were other prevailing arguments.

A lack of standing is good, since then they never need to decide anything else, since they have no right to present the claims.

Better to have them thrown out for that reason than to give them a platform to talk about how inequitable the Amis are to the children south of the border.

My concern too.

Best case would have been someone who would have been hurt by this law being enacted to sue. An illegal.

Then, have ICE deport him. (Yeah, I know I’m dreaming, ICE doesn’t really exist, except on paper)

The only part of the ship that is righting itself is in Prince William County. Alexandria, Arlington, Fairfax County, Falls Church etc. are all virtual sanctuary cities. Springfield has gang wars where they cut off each others’ limbs with machetes. Alexandria is in the process of building more “affordable” housing for people it KNOWS are illegal. The public schools have been ruined beyond redemption. And Maryland is just as bad, if not worse. It is a sad, sad scenario here within the Beltway, where large areas of America have been turned into Third World hell holes.

My coworker had a similar experience. She brought her brother to the emergency room, and of course they asked him if he had insurance. He didn't. They wanted a $10,000 deposit, which he didn't have. Meanwhile, illegal alien after illegal alien was ushered in to be treated, like kings, for free.

Many people here in LA have had auto accidents with illegal aliens. My best friend's fiancee was almost killed by a drunken, unlicensed, uninsured illegal alien.

I'm so glad things are better where you are! I hope and pray that soon more communities will be able to say the same.

The entire state of Maryland - and everything north of Woodbridge and east of Falls Church in NoVA (I lived off of Rt. 7 during my 1st marriage) - has been subjugated by the rabble living along the I-95 corridor. People on the Eastern Shore and in the Western panhandle don't want this shit; they're just looked at as the flyover country of the Delmarva, and a source of extra revenue. I'm positive my father is at the local veteran's cemetery, spinning in his urn. He was a radio broadcaster up there for over 40 years, and railed against this tripe.
