Woman sues for being born
(Filed: 11/11/2005)

An Australian woman who is deaf, blind and physically and mentally disabled wants to sue the doctor who allowed her to be born.

Lawyers for Alexia Harriton, 24, who needs round-the-clock care, made the application yesterday to the Australian High Court, arguing that her mother's doctor was negligent in failing to diagnose rubella infection early in the pregnancy.

Lawyers said that if her mother, Olga Harriton, had known of the extent of the disabilities, she would have had an abortion.

"We are here for Alexia, for justice," Mrs Harriton said. "That's all it is."

So... if a law suit is filed, shouldn't it be against the parents?

Lawyer: See, she said "Yes." Do you want to sue everone responsible for your birth?

So you know why?

Because many pro-choice folks consider a "woman who is deaf, blind and physically and mentally disabled" to be little more than a bunch of cells.

They refuse to grant the dignity that comes with person-hood to both the severely disabled and the not-yet-born.

This poor lady is deaf, blind physically and mentally ill, she doesnt want to sue anyone. The people who have custody of her are the ones doing the suing and its all about the money.

They are trying to do "what's best" for her "interests". It isn't a "quality" life.

You'll notice that it is her caregivers who are giving up on her. She is not the one bringing the case, her guardians are doing this. Same as Michael Schivo. They don't always have your best interest at heart.

It's why there is spouse and child abuse too. Just because someone is "in charge" doesn't mean that they will make the right or proper decisions.

My husband's cousin has CP. Her mother has taken care of her and takes her almost everywhere she goes. She is probably one of the most loved members of the family.

That's consistent - they count as "children" when calculating gun crime.

More information here. It's even worse than that - there's no indication that the 3-year-old in the linked story is mentally disabled.

Thanks, I missed the glasses! I knew someone who was legally blind but passed a driver's test.

In Florida I believe it's compulsory.

The story really isn't a philosophical one...it's a simple case of wanting money for help in taking care of her daughter. But I do take exception with this sentence you wrote:

Man does give soul life, even when God had no plan to do that...they're called Doctors. And you see it everyday. I watch those medical shows too. Every single day there are babies born by extraordinary means, means that God did not plan. I believe, and it is an unpopular belief here, that God's perfect plan included babies who were sickly NOT to be born, but the goodness of man couldn't help themselves. So here we are...babies being born that weren't meant to be born according to God's plan. I'M NOT SAYING THAT'S A BAD THING, I'm just saying that everytime I hear the term "GOD'S PLAN" I cringe a little. The minute man got involved, it's no longer God's plan and it's complete hubris to think so, and intellectually dishonest to use it as an argument.

Where exactly did "man" get the intelligence to become a "doctor" or a "lawyer"??? The requirement given was to be born from above through woman, the flesh was never intended to be the body of eternal life.

Luke the apostle was a DOCTOR.

I'm sure this woman loves her daughter...Some lawyer came along and said she could make some money and I, for one, will not judge her for probably needing money after 24 years of taking care of a permanently disabled child.

The Heavenly Father NEVER does anything without warning first, does that fit with what Pat Robertson said??? One thing is for sure that "storm" was allowed to happen, however, NOBODY can claim they were NOT warned.

Yet interestingly every time I saw a person who survived that storm, thanked God they were still alive.

Allow and giving the flesh the "free will" to choose does not exclude a Heavenly Plan.

Now while it is sad and very uncomfortable to see and read about people with disabilities from birth or via accidents, does not lesson the value of their "soul". This gal would seem to fit in a category of innocence, and while we who have abilities to communicate seem to be the ones tested not the disabled innocent ones.
