I doubt very much that she would have "known" the extent of the disabilites while she was still pregnant. All the doctor could have done, if in fact he knew the mother had rubella, is advise her on the POSSIBILITY of it deform her yet unborn child. There is no absolute certainty that any disability would have been the case.
The question is, would the mother have aborted her child without any certainty at all that the child was harmed? You cannot use the knowledge you have today to make the decision then. Case dismissed for defendent.
If this woman is sooooo unhappy for being born, but is capable of suing, then she's capable of committing suicide - problem solved.

It just seems to me that it's a matter of faith, one must not be an extraordinary person to "qualify" for God's grace.

I know some people who are deaf, mute, blind, and mentally and physically inpaired. I also learned to communicate with them. None of them wish they were born dead. In fact, of the thousands of mentally limited people I know I can not think of one who is adament about wishing to have never been born by virtue of their disability.
I have known lawyers who filed lawsuits on behalf of orphaned people who, presumably, do not have the ability to make choices for themselves. Their claims are always high sounding moral nonsense.
This is one more slander against people with disabilities. I wish these lawyers and their money grubbing pity parties were aborted.
Do we need tort reform or what?
I think "we" are here for someone else too.
Pure evil.
How do these things ever get to court? What is there to discuss or "discover" in court at this point? ARGH!!
The solution is simple. Abort her now.
My solution?
1. Dismiss the case.
2. Send the woman to a state asylum.
3. Kill her lawyer.
How sad! God's grace is available to all!

That story is sick! Are they going to "make" her a lesbian too?
I googled for an update on it, maybe a glimmer of hope, but couldn't find anything.

And after 24 years she is determined to abort her child. Better late than never.

She figures that for 24 years a wrongdoing has been done to her. This poor mother has suffered the consequence of looking after a deaf, blind and physically and mentally disabled girl, who needs round-the-clock care and has wasted 24 years of her life when she would've been better off dead.
Just when on earth did a blind, deaf, physically and mentally disabled girl decide to sue the obstetrician?
This title is deceiving. It should read: Mother sues Doctor for allowing daughter to be born.
