SEN. SCHUMER CAUGHT ON CELLPHONE: 'WE ARE GOING TO WAR' OVER SUPREME COURT

**Exclusive**

Senate Judiciary Committee member Chuck Schumer got busy plotting away on the cellphone aboard a Washington, DC-New York Amtrak -- plotting Democrat strategy for the upcoming Supreme Court battle.

Schumer promised a fight over whoever the President’s nominee was: “It's not about an individual judge… It's about how it affects the overall makeup of the court.”

The chairman of the Democratic Senatorial Campaign Committee was overheard on a long cellphone conversation with an unknown political ally, and the DRUDGE REPORT was there!

Schumer proudly declared: “We are contemplating how we are going to go to war over this.”

Schumer went on to say how hard it was to predict how a Supreme Court justice would turn out: “Even William Rehnquist is more moderate than they expected. The only ones that resulted how they predicted were [Antonin] Scalia and [Ruth Bader] Ginsburg. So most of the time they've gotten their picks wrong, and that's what we want to do to them again.”

Schumer later went on to mock the “Gang of 14” judicial filibuster deal and said it wasn’t relevant in the Supreme Court debate.

“A Priscilla Owen or Janice Rogers Brown style appointment may not have been extraordinary to the appellate court but may be extraordinary to the Supreme Court.”

By the time the train hit New Jersey, Schumer shifted gears and called his friend and “Gang of 14” member, Republican Sen. Lindsey Graham.

The two talked in a very friendly manner about doing an event sometime this week together.

The same way I heard Bob Shrum yakking on his cell phone on the Acela from Boston to NYC three days before the Wellstone Funeralley. I posted what I heard and folks like you denied it could have happened, until that Ass Harkin from Iowa gave a speech that I heard him dictating over the phone and posted segments of it.

The Dems think they can steal this appointment (along with any others that fall to Bush). The sad thing is, they have a strong shot at it. Tie it up until a Democrat is in office, and watch the Republicans cave in.

No I am not, and a simple pointing out of his stands on issues wouldn't be a problem either. But that isn't what has happened here. The massive attack was incredible.

Personally, I didn't think he was going to be nominated, therefore the panic was almost embarrassing to watch.

What happened here is just a small part of what has been going on in general and it's bad.

More and more we are taking on the appearance of the loony left, with vitriol and venom and we're going to defeat ourselves. What's worse, we'll deserve it.

There was not "wire-tapping" involved. There is no law against eavesdropping. Thankfully.

I completely abhor Mr. Schumer's political positions, but I also abhor the fact that a Senators private conversation is lifted and broadcast without his consent.

I hope the good citizen within earshot happened to have some sort of device to make a recording of the conversation possible. Recording a politician on a public train is hardly an invasion of a politician's privacy.

I agree we should not be demonizing Gonzales.

I think what you're seeing in some of the over-the-top comments is conservative frustration ... and fear.

There is a long history to all this that has nothing to do with Gonzales personally.

I trust someone in the inner circle understands how much conservatives need to see a clear, indisputable "win" on this nomination.

A few years back someone taped a phone call by Newt and published the text. No outrage at all from the left. No one taped their call. Screw them.

Developing… These people are going to war while our folks play the fools. It sounds about right for the senate. Senator Graham is toast when he runs for reelection in 08 because conservatives will decide the Primary, and money will be no object in "Daschling" this POS RINO!!

Senator Graham is toast when he runs for reelection in 08.

There is one thing that may save him ... taking a vocal lead in pushing through this Supreme Court nomination, up to and including the nuclear option.

I think the embarrassment of this Schumer flap makes that more likely ... but we shall see.

It is mostly a waste of time and energy unless he is actually appointed imo. It is in the same vein as the Schumer attitude because it sets you up to be disappointed/against any nominee as not being "perfect" and it makes the game about the fight instead of the results. I prefer results over a good fight. But...that's just me.

It also allows the press to play you like a fiddle because they know where your buttons are and they are going to push them at every turn to make conservatives look foolish and reactionary. They like conservatives all hysterical and frothing at the mouth because it doesn't sell well with the average guy. And they'd really, really like to see the dems back in charge. Don't help them.

That also is NOT blind support...it's just not assuming it will always go against me, which is a victim mentality which I abhor, left or right. It is victim-hood that allows one to feel righteous and perfect and better than everyone. It also means one never has to be responsible for actually moving things forward.

When someone is speaking on a telephone in a public place, and he's overheard, that's completely different than using an electronic device to evesdrop on both sides of a private telephone conversation and record it.
