SEN. SCHUMER CAUGHT ON CELLPHONE: 'WE ARE GOING TO WAR' OVER SUPREME COURT

**Exclusive**

Senate Judiciary Committee member Chuck Schumer got busy plotting away on the cellphone aboard a Washington, DC-New York Amtrak -- plotting Democrat strategy for the upcoming Supreme Court battle.

Schumer promised a fight over whoever the President’s nominee was: “It's not about an individual judge… It's about how it affects the overall makeup of the court.”

The chairman of the Democratic Senatorial Campaign Committee was overheard on a long cellphone conversation with an unknown political ally, and the DRUDGE REPORT was there!

Schumer proudly declared: “We are contemplating how we are going to go to war over this.”

Schumer went on to say how hard it was to predict how a Supreme Court justice would turn out: “Even William Rehnquist is more moderate than they expected. The only ones that resulted how they predicted were [Antonin] Scalia and [Ruth Bader] Ginsburg. So most of the time they've gotten their picks wrong, and that's what we want to do to them again.”

Schumer later went on to mock the “Gang of 14” judicial filibuster deal and said it wasn’t relevant in the Supreme Court debate.

“A Priscilla Owen or Janice Rogers Brown style appointment may not have been extraordinary to the appellate court but may be extraordinary to the Supreme Court.”

By the time the train hit New Jersey, Schumer shifted gears and called his friend and “Gang of 14” member, Republican Sen. Lindsey Graham.

The two talked in a very friendly manner about doing an event sometime this week together.

This was never about the 'balance' of the court - it is all about denying the President the ability to appoint a Conservative or Constitutional Judge while preserving their 'right' to stack the court with 'moderates', i.e. flaming liberals.

Chucky and the rest of the liberals should fool no one.

Oh, please, please, please let Chuckie go after the nominee on the gay marriage issue. It would disgust the country so much there would be a groundswell of support demanding that the Pubs resort to the nuclear option. Chuckie is so dim and predictable that Rove can play him like a fiddle.

Senator Graham has taken a lot of flack for his participation in the Gang of 14. That, and his friendship with Chucky and Hillary will certainly not help him in South Carolina.

But, he can silence much of the criticism if he goes to bat for Bush's SCOTUS pick (assuming its a conservative one). He said that the Constitutional/Nuclar option is still on the table if the Dems go back on their word, so he had better be ready to live up to that.

Even though he may have largely been a RINO, every mention of Schumer makes one wish that D'Amato had held onto that seat.

Looks like some reporter (possibly Drudge) was on the train to NY from DC with Schumer and overheard him, no different from the press overhearing and reporting that Cheney told Leahy to go ... himself.

I wish that were true. Unfortunately, exactly the opposite will happen. The MSM will make Schumer the great warrior who is out to save the country from right-wing extremists. They will go to lament how his intensions are more important than his actions. Have a large supply of barf-bags ready.......

Schumer's position is that the federal Constitution does not require same-sex marriage or the recognition by one state of another state's same-sex marriage. In other words, that DOMA is constitutional and sufficient. He said that earlier in the week. What he basically wants to convey is that the Federal Marriage Amendment is unnecessary. Whether or not he has ulterior motives (no doubt) is another matter altogether.

I don;t believe you can recess appoint a Supreme Court Justice. And I think it would be disasterous to try, even if it were borderline legal. I think all eight of the Justices would refuse to accept any such appointment.

George Washington appointed John Rutledge as Chief Justice by recess appointment. Justices Warren and Brennan were initially recess appointments of President Eisenhower.

I don't know which is worse?

Chuck SCHUMER, being just the scumbag he is (a scorched-earth, zero-sum, liberal Democrat at War with Constitutional Traditionalists), or THE PRESIDENT HIMSELF, whom I heard on the radio this morning, decrying 'the extremes' activity over this premiere, high stakes Judicial appointment battle.

Listen closely! He did not take on the extreme LIBERALS, just "THE EXTREMES", which to me means "extreme liberals AND Conservatives". In other words, the words of a RINO trying to play it right down the middle. (Just like his statement about being against "vigilanteeism" when asked about the Mexican Border operation.

So help me, be had better not (politically speaking), go down this mealy mouth, spineless "middle road", putting strict Constructionist Economic/Social Conservatives on the same very plane in this battle as COMMUNISTS, ATHEISTS AND LIBERALS.
