SEN. SCHUMER CAUGHT ON CELLPHONE: 'WE ARE GOING TO WAR' OVER SUPREME COURT

**Exclusive**

Senate Judiciary Committee member Chuck Schumer got busy plotting away on the cellphone aboard a Washington, DC-New York Amtrak -- plotting Democrat strategy for the upcoming Supreme Court battle.

Schumer promised a fight over whoever the President’s nominee was: “It's not about an individual judge… It's about how it affects the overall makeup of the court.”

The chairman of the Democratic Senatorial Campaign Committee was overheard on a long cellphone conversation with an unknown political ally, and the DRUDGE REPORT was there!

Schumer proudly declared: “We are contemplating how we are going to go to war over this.”

Schumer went on to say how hard it was to predict how a Supreme Court justice would turn out: “Even William Rehnquist is more moderate than they expected. The only ones that resulted how they predicted were [Antonin] Scalia and [Ruth Bader] Ginsburg. So most of the time they've gotten their picks wrong, and that's what we want to do to them again.”

Schumer later went on to mock the “Gang of 14” judicial filibuster deal and said it wasn’t relevant in the Supreme Court debate.

“A Priscilla Owen or Janice Rogers Brown style appointment may not have been extraordinary to the appellate court but may be extraordinary to the Supreme Court.”

By the time the train hit New Jersey, Schumer shifted gears and called his friend and “Gang of 14” member, Republican Sen. Lindsey Graham.

The two talked in a very friendly manner about doing an event sometime this week together.

Developing…

I can see your assertion and appreciate it. However,The President of the United States, putting in a strict constructionist/originalist as a key USSC Justice, who no doubt will be THE tipping vote to effect our lives for the next thirty or so years--keeping us one step away from Culture of Death/Culture of Atheism Judicial Tyranny, MEANS MORE TO ME at this point than any amount of his personal loyalty to any friends he may happen to have.

The President's BIGGEST FRIEND is the United States itself and it's future.

Gonzales may be a fine man, but if he is then he can stay in the post he has only recently been selected for.

"I don't think you got the memo: There already was a groundswell of support for the "nuclear" option. The GOP, natch, caved."

You are right, I didn't get the memo. If there really was such a groundswell of support I didn't hear about it and would greatly appreciate some documentation of this groundswell so I can use it when debating my lib friends.

No - I did not record and get this on a .wav or .mp3 -

What I - personally on WABC 770am NYC - heard Lynnie Graham say was this crud :

(paraphased - of course! GMABAB!)

"SCOTUS justices are not that important - there are so many - what is important is the dignity of the Senate - and how the Senate is viewed here and abroad....."

GMABAB!

Captain Lightfoot of JAG speaks!

The official defense attorney of Abu-Grabyou and Camp Gitmo terrorists spews forth!

My conservative daughter or my lib NYC sister could whip this silly wimp with their left hand - in one quick jab!

"The MSM will make Schumer the great warrior who is out to save the country from right-wing extremists"

It is unfortunate but you are right.

Any Freeper from NY want to call CLUckie's office and ask for a response? I'd love to hear the sputtering, gnashing, backpedalling excuses.

"Can you blame him? The character assassination of Gonzales right here on this board was totally disgusting."

Who is character assassinating? You mean we can't examine a judges voting record or rulings? Since when has that been an attack to question valid criteria?

xkaydet65 said: "I don't believe you can recess appoint a Supreme Court Justice."

Yes, you can.

The problem is that recess appointments are temporary, until the end of the next Senate session. They are not lifetime appointments.

If a Demoncrat President ever happens again, he would automatically get a Supreme Court nomination at that time. Such a recess appointment would be a highly unproductive use of an opportunity to select a Supreme Court Justice.

The same problem is of lesser concern for a cabinet post or any other appointment of one who serves at the pleasure of the President. A new President can replace them immediately upon taking office. There is little lost by using a recess appointment.

Memo to Chucky: If you go to war over the Supreme Court you'll lose, because the left doesn't know how to fight a war.

From a reader: "just read on drudge about schumer's cell phone comments overheard today. at least liberals have found one war they will support."

I think all eight of the Justices would refuse to accept any such appointment.

Is there something in the Constitution that says they can do that?

But the thing is, the man has not even been nominated. That didn't stop anyone.

Fine to discuss the various positions of someone AFTER they have been nominated.

We have the power to influence our legislators during the hearings.

The mad dash to assumptions has been awful.
