Some of you folks are the most negative people I know -- the President could nominate the most strict Constitutionalist and some of you are going to be wringing your hands. Why let Pres Bush's record of judicial nominations get in the way of "what could happen?"

If we can't get a conservative on there , we should not nominate anyone.
The problem is, it's not "we" who will be making the nomination and fighting the fight. It's Bush and his "new tone" and the spineless wimps in the Senate. "We" would probably be all right, but there needs to be a Constitutional amendment allowing some delegation of Freepers to nominate and then fight for approval of Supreme Court Justices.

while the Regress is in recess, Mr. Bush should appoint someone whom the 'Rats simply cannot stand.
Mark Levin, possibly. Bork is probably too old, but might relish a little bit of payback. Laura Ingraham would be a good choice, were she healthy.
Then, Mr. Bush could say to Dur binLaden, ''Hey, the faster you vote on Luttig (or Garza, whomever), the faster Levin is off the Court.''

Rehnquist will take this opportunity to step down as well. This would be a good move for the conservatives.
Why? Because a fight over 2 justices will be no uglier than a fight over just 1. It will force the issue in a way that will make it even more difficult for the Dem's to filibuster.
Look for Rehnquist's announcement to follow shortly after O'Connor's.
