Is it time for a March on the SCOTUS and the Judiciary and the Senate?

Are you as fed up as I am over the bad decisions being handed down by the SCOTUS and throughout the judiciary? Are you tired of judicial activism? Are you tired of being ruled by the men in black robes? Is it time to remind the SCOTUS that We The People ARE the final arbiters of law and justice in this land?

Are you fed up with the weak-kneed Republican Senate? Are you ready to drop the nuclear option on the obstructionist Democrats? Are you fed up with Specter and the RINOs?

Is it time for us to rise up and march on Washington again? How many of you are willing to join me in another march to D.C. to straighten out these yahoos and remind them of who's in charge in this republic?

If they can do it in Lebanon, we can do it here!!

I'm not sure if anyone else has already mentioned this (still reading down the scroll..), but the death penalty has been off the table for your 14 yr old shooter for quite a while now. Can anyone help me remember the date and/or name of that ruling?

There's nothing wrong with having respect for the court - you just cannot allow it to blind you to the truth of your job. I believe Scalia is completely convinced this court is out of line. I saw him with another justice on CSPAN and his arguments were right on. The other guy was saying we needed to use international law and Scalia was totally against that - instead saying the Constitution is the only guide to be used.

If you're looking for perfection - you'll never find it. These people are humans just like the rest of us. The problem lies in their interpretation of what their responsibility is to America. They are not there to MAKE UP LAWS WHICH SUIT THIER MORAL CAUSES. They are there to interpret what the previously written law says. They are not doing that - and they need to be yelled at!!

So...a 5 year old recently killed his 3 year old sister here. Are you going to strap a crying 5 year old to the gurny and push the meds that will kill him? I for one have a major, major problem with that.

Wow. I'm not sure I've heard about that case. (By the way, Texas law currently cuts it off at age 16 I believe, and I can live with that. It is our law. I can't see a 5 year old being sent to the death chamber).

Did you see Scalia's written dissent? Rehnquist and Thomas signed onto it. The 5-4 decision throwing out the juvenile death penalty went AGAINST the Supreme Court's own decision 15 years ago apparently. AND Scalia also noted that he was AGAINST the trend of SCOTUS to look to FOREIGN laws and influence to come to their decisions. That he wrote that in the dissent is very revealing and I totally agree with him. I have NO tolerance for these idiots ignoring U.S. law and rulings and looking to Germany, France, etc. for guidance for U.S. lawmaking decisions. That is pure BS!!

I like your idea. I could see the protestors lining the way to the steps of the SCOTUS, waving the flag of the US, and having a few members of congress deliver the Constitution back to the USSC.

I can see banners and signs clearly stating the same thing...

What? does this mean?

It means that the USSC only has as much power as we allow it to have. President Jackson didn't agree with the court's ruling so he simply ignored it. The men (and women) in the black robes have no ability to enforce their rulings; there is no court controlled police, none of the branches of the military report to the court, etc.

I pretty much agree. No basic argument here. I think though that States Rights can only be enforced with a SCOTUS that acknowledges same. No question that we need to drive the Congress to act on that front as well but my feeling is if we are succesful in chaninging the mix of SCOTUS, States Rights will sort itself out, vis Scalia's comments. IMV the SCOTUS problem trumps everything except National Defense (including SS) until we get it fixed. Those ghosts are destroying our country and making a mockery of our constitution.

Sorry, you're mistaken. POTUS has no authority of SCOTUS whatsoever.

It is a matter of enforcement. POTUS has the Justice Dept and Military both of which are required for enforcement. POTUS can (temporarily) nullify a SCOTUS by refusing to enforce. Completely within the bounds of the Constitution (and intent of the founders by the way)

Age has little to do with it and your example may illustrate that. I submit that a 5 year old is most likely not able to act with full understanding of the consequences, likewise a 17 yr 11 month and 29 day old may not as well but most probably would. That is precisely why these issues should be decided by juries informed by the specific circumstances and guided by STATE laws appropriate to the jurisdiction where the murder was committed. BTW when was the last time you heard of the death penalty being applied to a 5 year old...Choose a realistic example to make your point or the point is lost.

Waste as much time on this project as you want. Our paid representatives in D.C. neither know, nor do they care what we want. They all have their hands out to special interests, and only worry about us suckers at election time.

The solution is not marches and protests. The solution is forced term limits. Never, ever vote for an incumbant office-holder. Keep them off-balance and incapable of building strong power bases.

One of my fellow Arkansas Freepers has posted a brilliant proposal for campaign finance reform, on the Arkansas page. Hal9000 suggests that congressmen and senators only be allowed to take contributions from registered voters in their home districts.

I think that is something worth looking into, especially if there were to be a very low cap on such contributions.

As things now stand, what we the people want only matters during reelection campaigns, and these slimeballs show up with barrels of pork and promises of more and more of it if we'll only vote for them one more time. How stupid are we?

I think we get the answer to that question every time we go and blindly vote for the thieving, pompous, bought-and-paid-for ba$tard$.

Just checked the poll. This issue is made for Freepers and only 45 of us have signed on.... Maybe we should just have lunch instead and let the country go to h3ll. Is the Free Republic community really this apathetic? Hot air and no substance?

And who pray tell is going to vote to pass that law...not any congressman or senator I know...and protests and marches have a rich history of changing the course of events in our country.

Great idea, Jim. Let me know the date and I'll see what I can do.

May I suggest the main target of demonstration be the Congress? They are to keep the Court in check and they are not doing so. Congress should have long, long ago passed laws to protect the Decalogue and Under God in the Pledge from Judicial Review. The executive and legislative branches are checking each other, but nobody is checking the Judiciary. It has become a government unto itself, which is unacceptable.

Everytime I use this argument to say that Bush could end abortion tomorrow if he wanted, I am flamed like there is no tomorrow. He has no duty to adhere to UNConstitutional rulings and could declare that life starts at conception and that unborn children have a right to life liberty ...shall I go on?

IMO that isn't the answer either. The Executive and the Judicial should be bound by the 10th. If they refuse to act in such a manner, IMO it is up to individual states to declare that a given SCOTUS ruling is null and void within their boundaries - which would allow a state to outlaw abortion and then tell SCOTUS to stuff it.
