McDonald’s is being sued over a hot coffee spill, again.
This time, a San Francisco location is being accused of serving a “scalding” cup of coffee with an improperly attached lid, which allegedly resulted in the coffee pouring out on plaintiff Mable Childress’ body and causing “severe burns” after she tried drinking it.
The lawsuit, filed last week, alleged that the elderly woman is suffering from “physical pains, emotional distress and other damages.” The restaurant’s negligence was a “substantial factor” for her injuries, it alleged.
Childress also said in the lawsuit that the restaurant employees “refused” to help her, a point that the McDonald’s denied.
“We take every customer complaint seriously and when Childress reported her experience to us later that day, our employees and management team spoke to her within a few minutes and offered assistance,” the McDonald’s franchisee owner, Peter Ou, said in a statement to CNN.
“My restaurants have strict food safety protocols in place, including training crew to ensure lids on hot beverages are secure,” Ou said, adding that the company is “reviewing this new legal claim in detail.”
This case echoes the famous McDonald’s hot coffee lawsuit several decades ago, in which another woman spilled coffee on her lap and suffered third-degree burns. Third-degree burns are the most severe and penetrate through the entire skin.

First world problems. It’s no big deal compared to when Newsom signs the new fast food minimum wage. There won’t be fast food. Eventually, California will turn from America’s garden to food desert. I really don’t care if these Marxists starve themselves.
Evidently it is too dangerous to sell coffee to women because they don’t know how to handle it safely.
A couple microwave ovens on the counter and start serving COLD coffee and tell them to heat it up themselves
Not coffee-related, but there is an Asian supermarket near me where I go on occasion for authentic instant noodles from various countries (try the kimchee udon noodle soup).
In the front is a pharmaceutical section. It appears to have balms but I can’t read what is in them. I couldn’t find one that was “Maestro-approved.”
I also noticed that there are no oranges in the Japanese food section.
I like stupid people. They write checks.
This, of course, means, I’ll never have a hot cup of coffee ever again.
I will say that occasionally those lids are not fastened correctly, and they will pop off when you pick up those flimsy cardboard cups. If that happens, coffee will spill out of the cup and onto your hand where the smart thing to do at this point would be to drop the cup to the ground or counter rather than continuing to hold it. (I generally, against my better interest, hold it, and let my displeasure be known. I have never sued McDonald’s however.)
85 year old woman at the McDonald’s drive thru. Cool.
I’ve never understood why someone reversed the “burn severity” scale after my Boy Scout days.
In today’s environment I could see laws mandating temerature measurement to within 1 degree and being required to provide PPE including a protective apron and gloves, with a “smart lid” that prevents drinking outside the safe temperature range. And a “Coffee Safety Officer” in each McDs.
I remember this picture of a world War 2 era soldier.
I remember seeing a similar picture ,side by side with Pajama Boy from Obama’s time, and the caption read, American men in the 1940s ,and American men today. Then the viewer would make the comparison between our World War II era soldiers and today’s Pajama Boy type.
The little markets in Chicago run by Southeast Asians are fabulous, with oodles of interesting fresh produce. But no dairy products. And yes, a heaping spoonful of kimchee at the bottom of a bowl of noodles — even a 25¢ packet of ramen — makes all the difference.
“improperly attached lid”
I think we’ve all had that happen, and if it was a restaurant employee who put the lid on, then I think they’re probably going to have to pay. That little disclaimer on the coffee cup won’t save them from paying for employee negligence.
[[Childress also said in the lawsuit that the restaurant employees “refused” to help her, a point that the McDonald’s denied.]]
Have they seen some of the employees who work there? They act like you are bothering them if you ask for an extra ketchup packet
Or they could serve only iced coffee. But the other idea works too.
At least in a drive through
good point-
I would just avoid the fried bat wings.
Sadly, kimchee is now off my diet (I hadn’t realized what the sodium content is). Maybe in moderation...
