Alec Baldwin: ‘Rust’ Lawsuits Targeting Those With Deep Pockets, Not The Actual Negligent Parties

Alec Baldwin claims the wrong people are being charged in lawsuits related to the fatal shooting of Halyna Hutchins on the Rust film set.

Speaking Saturday at the Boulder International Film Festival, Baldwin told moderator Rod Bostwick “deep-pocket litigants” are being targeted, rather than those who were potentially negligent in the incident.

“What you have is a certain group of people, litigants and whatever, on whatever side, who their attitude is, ‘Well, the people who likely seem negligent have no money and the people who have money are not negligent,’ ” Baldwin said, as reported by CNN.

Baldwin was working with a prop gun on the Rust set last fall when it fired, killing cinematographer Hutchins and wounding the film’s director, Joel Souza.

“All my career, without incident, I’ve relied on the safety experts there to declare the gun safe and never had a problem, and this happened,” Baldwin said.

“Of course, this is to me sometimes it’s, it’s so surreal, I don’t even know what to say,” Baldwin added. Hutchins’ family has filed a wrongful death lawsuit naming Baldwin, the production companies, producers, and other crew members. At least two of the film’s crew members have also sued Baldwin and other production figures.

Baldwin talked of the support he’s received, pointing to his 40-years in entertainment without any safety issues.

“When someone, whose job is to ensure the safety of a weapon, hands someone else, whose job is to be the secondary layer of protection for safety of a weapon, and they hand you that weapon, you declare that that weapon is safe,” said Baldwin.

“That’s how I’ve done it my whole life because you’re not allowed as an actor to declare the weapon … I mean, the joke is, you don’t want the actors doing the safety

Attorneys could speak better to this issue but as I recall, when there are multiple defendants in a negligence case and joint and several liability applies, the plaintiff can sue any responsible party for the full amount of damages. Because the most responsible and the wealthiest is probably Alec Baldwin, I really don’t see any injustice here. Watching a piece of human trash like Alec Baldwin go through the anguish of a trial is just an added benefit.

Just imagine if, instead of going into instant denial, Baldwin had rushed to offer whatever aid he could, attempted to calm his co-workers, rode in the ambulance with one of the victims, waited at the hospital for friends and family to arrive, had his publicist issue an immediate press release detailing the accident, and how devastated he was that he was at the very least partially responsible for it, and unhesitatingly assisted law enforcement in the investigation.

There would obviously have been a large settlement, probably mostly paid by the production’s insurors, but the world would have looked at him as a man who took responsibility for his actions, and probably even sympathized with him.

But that didn’t happen. This screen hero turned out to be a coward in real life.

I don’t think so. He and his attorney(s) are working that angle to the maximum effect, to minimize legal responsibility and financial damage to him. Suddenly, everything he said after the murder is very carefully-crafted and on-script.

If the plaintiff can prove what was being done on the set was inherently dangerous, for example a requirement to point guns at people in order to film a scene, then they might not have to prove negligence at all. They might get a judgement under a strict liability rule.

from what i remember reading about this, this scene wasnt alec pointing at any other actor, it was to be a camera shot of him drawing at a person you can’t see, off-screen.

Am I wrong or is this a civil case brought by her family seeking damages?
Still no criminal charges?
Is it common to have a civil case about a murder before a criminal charge? Nope.
Thank your deep pockets and your politics for that.
Maybe you should check with officer Potter about an equal justice system before whining to the press. You should already be doing time.

If you check the gun in front of me, tell me it is not loaded, and then hand me the gun, the first thing I will do is check to see if it is loaded.

That was the first rule my father taught me about handling guns when I was 6 years old, and in almost 60 years since then I have never accidentally fired a gun thinking it was not loaded.
