... what can we make of Alec Baldwin’s shooting death of Ms. Hutchins? Could it have been an innocent accident? Or is it merely civil negligence? Or is it criminal recklessness, and involuntary manslaughter? The answer will, of course, depend on what the facts are ultimately turnout to be, but we can certainly explore the range of outcomes that would be on the table.
Innocent accidents can happen with firearms, but they are rare—and the reason they are rare is that firearms are recognized legally as inherently dangerous instruments, and therefore the standard of care for handling them is very high.
...
...there’s another factor in this tragic event that will likely play a role in civil liability, and perhaps criminal liability, if any, for Alec Baldwin.
...Alec Baldwin was both the actor handling the firearm when it discharged—and an actor might argue that he is at the “bottom” of the safety responsibility ladder for something like a movie set—but he was also a co-producer for the film—which would place him at the “top” of the safety responsibility ladder.
In theory, an actor at the “bottom” and the producer at the “top” might each point their finger at each other in the case of a tragic event like this. ...
In this case, however, Alec Baldwin occupies both seats. So he can point his finger in this manner if he wishes, but ultimately he’ll be pointing it at himself.
And this implication could well apply not merely in the civil law context, within the scope of negligence, but also within the criminal law context, within the scope of recklessness and involuntary manslaughter.

My question is - who was more wreckless in their respective "accidents": Alec Baldwin or Ted Kennedy?
He won’t get in trouble.
Some responsibility as the shooter......Perhaps more responsibility as the Producer.
Anytime you handle a gun you are responsible for whatever happens.
Alec Baldwin called for murdering Henry Hyde and his family during Clinton impeachment.
Percussion cap and ball. Very strange gun to have an accidental load in it.
If you show a gun in Act 1, it has to go off in Act 3.
We were told he was rehearsing a scene and yet the two people shot weren’t actors.
no perhaps about it
as producer who hires and fires, he’s got liability
Kennedy, absolutely.
(or is that “Absolut”ly?...)
The county this all occurred in voted for Biden 77% to 22%.
He walks.
Maybe Spike Lee trained him on how to shoot.
It reminds me of the Great White Station Nite Club fire in 2003. Is the singer who lit the pyro to blame, along with the club owner and the fire marshall who passed the club for inspection? It didn’t have sprinklers, exits were obstructed, and the club had flammable material.
One thing I found strange is he shot the director and the director of cinematography. The director should be the top person, next to Baldwin the producer. The woman killed was a manager and might not actually been behind the camera when shot.
Also, if 2 people were hit, it is likely there was more than 1 live bullet fired. It seems likely to hit both of them, either he was aiming at them or he fired several live bullet more at random.
They are difficult enough to load when you intend on loading it and you know what you are doing.
Way too much missing information to even guess what really happened here.
It’s just like an episode in Columbo
I don’t see anything that would cause the trigger on that gun to pull itself.
Bingo. If anyone hands you a gun you assume it is loaded until you verify yourself it is not loaded. If he was a police officer who thought his gun was empty and accidentally killed someone, would he walk away scott free?
