What is the law on purchase of new merchandise that ships defective?
Please avoid bashing me because I use the sun.
I just purchased a solar hybrid inverter from a distributor in MA for $3000. I am in FL.
It does not perform correctly (as defined by an earlier model I already have that does work right)
By email the company admits to a defect in the original release. It was shipped in version 1.00.00 of the firmware. The product claims a 10 year warranty.
To fix the defect the company tells me to upgrade the firmware to version 1.3.0
That cannot be done without the purchase of another $500 accessory. The previous accessory model I currently use for my earlier model they have locked out of the interface claiming some new California regulation.
So I then tell them to send a tech for the warranty service and they do the upgrade. "No...this model does not come with field service."
175 lbs to ship back 1200 miles is not an option.
They have 7 more of these inverters to sell to other unsuspecting buyers still on their shelves.
When does a company cross the line and perform fraud on the buyer ?
It also appears the warranty requires the accessory purchase but is hidden in the sales process.
For those who want to know who and what to avoid...

Consider putting all that crap in your car and driving to Massachusetts to get your money back.
Ask them to lend you the accessory.
If no luck, maybe the accessory can be bought on a 30-day return basis.
I’m playing devil’s advocate:
Would a professional installer understand that they would need the upgrades in order to finish the job? If so than it is not the fault of the company you made an amateur mistake when you ordered the product.
Without more information from you and the company it is impossible to answer your question.
Buy the converter, use it and then return the converter.
Assuming the converter weighs less that 175 pounds.
Perhaps you can find a nearby company that can service your unit.
You might then only be stuck paying around $150 more than planned.
So this thing runs around $4000 and delivers 10,000 watts.
Plus the cost of the panels. How long is your break even point? I’ll bet it’s pretty close to the life of the panels.
How did you pay for this? If by credit card you could dispute the charges, especially if AMEX. I dont think debit cards are as flexible.
Firmware version incompatibility is super common in all electronics. You obviously never dealt with Allen Bradley before? I have had processors go incompatible with drives even before an installation is completed. Your tech rep should have the OEM software to flash up or down to make all your devices compatible within the system. That is if they are an authorized distributor or service depot.
If they know they need to update them, why are they not updating them? I know the answer, they want to make the money to send a field tech out. It was a rhetorical question. 8>)

Yes. Someone here is not an authorized distributor. Therefore they do not have the neccessary program keys to flash up or flash down firmware.
They can’t update them because they can’t predict what firmware the power supply and sub components have assigned? This is the risk you take by not having Ethernet connected equipment. If it was connected, automatic downloads revise the versions of firmware at power up when they boot.

My post says this model has no field support.
I suspect the warranty coverage is in the cloud and only their new fangled box can get that done.

Actually it was a technology requirement. The XW Pro is Rule 21 compliant for California. The new communications standard IEEE2030.5 has higher security standards. We needed a completely redesigned control board for the Pro.
I asked AltE to see if there was anything they could do to lessen the cost of the Gateway.

If you used a credit card to pay, put a hold on the charge and file a fraud claim with an explanation of your circumstance. Contact your local BBB and file a small claims court law suit in your county or city. Document everything in writing!
