We know that it's inconvenient to be stopped, but the time spent at this checkpoint is time spent ensuring your safety.
At some point in their lives, three out of every ten Americans will be involved in an alcohol and/or drug related crash. In 2012, more than 10,000 people were killed in crashes on U.S. Highways involving a driver with a BAC of .08 or higher. In Illinois 22.6% of drivers involved in fatal car crashes had a BAC over .08. Impaired driving is no accident- nor is it a victimless crime. Studies by the National Highway Safety Council show that approximately 35% of all crashes and 55% of all fatal crashes involve drivers who had been drinking. Impaired driving crashes cost the U.S. society approximately $37 billion dollars annually. Due to these staggering statistics we are conducting this checkpoint as part of the Drive Sober or Get Pulled Over national campaign.
Your driving skills can be seriously compromised even when your behavior is not observably "drunk". Alcohol and drug use cause impairment in reaction time, attention, tracking, comprehension and other skills essential for safe driving. Even when attempting to drive carefully, an impaired driver cannot compensate for those reduced abilities. In addition, alcohol and/or drugs affect your ability to judge, whether or not you are impaired, thus the reason to have a designated driver prior to drinking.
In 2011, 3,331 people were killed in crashes involving a distracted driver. Distracted driving is any activity that could divert a person's attention away from the primary task of driving. All distractions endanger driver, passenger, and bystander safety. These types of distractions include: Texting, using a cell phone or smartphone, eating, drinking talking to passengers, using a navigation system, watching a video and adjusting a radio, CD player, or MP3 player.
For drivers 15-19 years old involved in fatal crashes, 21 percent of the distracted drivers were distracted by the use of cell phones. Sending or receiving a text takes a driver's eyes from the road for an average of 4.6 seconds, the equivalent-at 55mph-of driving the length of an entire football field, bind. Before texting and driving, ask yourself, is this text message that important?

Important Illinois Traffic Laws
625 ILCS 5/12-603.1 ...Each driver and (every) passenger of a motor vehicle operated on a street or highway in this state shall wear a properly adjusted and fastened seat belt. Effective January 1st, 2012
624 ILCS 5/12-610.2 A person may not operate a vehicle on a roadway while using an electronic communication device. This section has exemptions which allow hands-free or voice operated modes.
625ILCS 5/11-907(c) ...upon approaching a stationary authorized emergency vehicle, when the authorized emergency vehicle is giving a signal by displaying flashing red, red and white, blue or red and blue or amber or yellow warning lights, a person who drives an approaching vehicle shall, (1.) preceding with caution, yield the right-of-way by making a lane change into a lane not adjacent to that of the authorized emergency vehicle, if possible...(2) proceeding with due caution reduce the speed of the vehicle, maintaining a safe speed for road conditions, if changing lanes would be impossible or unsafe.
Graduated Driver's License (GDL) Program
Illinois is one of the toughest states for new drivers, ensuring your child's safety! This program was enacted to reduce the amount of teen crashes. Some of the new GDL laws are listed below:
- Limited to one passenger, other than a family member, for the first year of driving
- No cell phone use while driving, except an emergency call
- Driving curfew is 10 P.M. Sunday thru Thursday and 11 P.M. on Friday and Saturday
- Two moving violations in a two year period will result in license suspension
- Underage drinking violations now result in drivers license suspensions
Seat Belts and Child Restraint Systems
-The seat belt usage rates are in the lower 90 percentile. These are some of the highest usage rates in the country.
-Study after study shows that seat belts do, in fact, save lives. Are you wearing yours?
-Seat belt usage rates tend to drop off at night and fatality rates increase
-Child restraint configurations can be very confusing to install in your vehicle. Proper installation is paramount to ensure your child's safety during a crash.
-If you have questions about your child's car seat contact your local hospital, police, or fire department. Many of these agencies have certified Child Safety Seat installers that will check your child's car seat free of charge.

This PD sets up a checkpoint on Route 64, with one officer and a radio set up in a stationary position while informing other officers of which cars they wish to see pulled over. There is apparently no real criteria for stopping someone, because the stationary officer is not following them to observe their behavior, but rather watching them drive by.
I wanted everyone's opinion on this, whether this is actually legal, and what you'd do in this situation. The flier cites a few laws, but none of them are actually relevant to the legality of the checkpoint itself.
I will also note that Carol Stream has one of the highest (if not the highest) DUI arrest rates in the state of Illinois.

I’m no lawyer but I don’t feel it’s constitutional. You’re being stopped and searched/observed with no reasonable cause. A high DUI rate is no reason to stop/search me.

Years ago I was taking my written test to renew my driver license.
The multiple choice question asked “After 12 am, what percentage of drivers are legally intoxicated?” I decided to skip the choices and wrote in “I don’t care because I’m not one of them.”
The DMV lady gave me a huge scowl.
Beware, Georgia law now also applies this principle to utility vehicles. They very conveniently forget to publicize this feature in order to ticket unsuspecting out of state drivers solely to increase revenue. A typical fine with State fees added will generally exceed $400.00 with two points added to your license. Cops could care less about the safety of the utility workers since they hide in an inconspicuous spot beyond the location of the utility vehicle. The utility vehicle is not required to put out warning cones or signs, they just have to turn on any color roof light. Any sharp lawyer can make a lot of money by winning a sizable class action suit to get this abomination ruled ambiguous or unconstitutional.
In Arkansas they used to have yearly MVI (Safety Inspection) done at Auto Service Shops or Gas Stations.
Then they did away with it in exchange for Random Roadside Safety Inspectons. Now AR LEO have the tool to pull you over and Search your Vehicle. This gives them TOTAL ACCESS to the vehicle to preform the MVI:
Interior to check Hibeam Indicator, Seatbelts and Parking Brake functionally.
Under the Hood to check Brake Fluid level, Emmision System Compliance.
In the Trunk to check Lights and Spare Tyre condition.
This provides total access to search for Drugs, Alcohol, Firearms any other Contraband Items.
And they Dont have to have Provide any Probable Cause.
Very Convenient isnt it ???

They don’t go after criminals as most don’t have any money.

Checking the parking brake and spare tire? LOL How bout taking it for a spin to check the cruise control and speedometer accuracy. Did they really overlook the defroster? And any bootleg mp3s in the stereo?

I suppose this is why Illinois calls it a “Roadside Safety Checkpoint” and do not mention “DUI” in the checkpoint’s name. They can claim it to ensure that it is a seat belt checkpoint and that any DUI citation or drug arrest is a bonus.
A friend of mine got pulled over by our local PD about 12 years ago and booked for DUI. No drugs or alcohol in his system. I personally think he has some form of narcolepsy that is undiagnosed, because he falls asleep with extreme ease, and this occurred at about 01:00. They never reimbursed him to retrieve his car from the impound.
The further from Chicago you go, the less frequently you see this kind of thing.
While they are checking for Seat Belt Compliance, Child Safety Seat Compliance, License, Insurance, and Registration Compliance, they can check the “immigration status” and hold for ICE to immediately have deport the illegal aliens and foreign nationals on expired visa, absconders etc.

Its more about Drug Mule busts in AR because IH-30 goes from Texas and right through Little Rock turning into IH-40 on in to Tennessee so thats a major West-East corridor for the trade. And only the X42 crime syndicate is allowed to handle the trade in AR. So it gives them the advantage by taking out the competition. And the LEOs get a major boost in Seizeures and Cashflow.

No driver is capable of driving while intoxicated, legally.
Drivers who are illegally driving because they meet the legal definition of intoxication is a different answer.
...while the other 77.4% get road rage and start drinking because of the stupid waste of time.
