This PD sets up a checkpoint on Route 64, with one officer and a radio set up in a stationary position while informing other officers of which cars they wish to see pulled over. There is apparently no real criteria for stopping someone, because the stationary officer is not following them to observe their behavior, but rather watching them drive by.
I wanted everyone's opinion on this, whether this is actually legal, and what you'd do in this situation. The flier cites a few laws, but none of them are actually relevant to the legality of the checkpoint itself.
I will also note that Carol Stream has one of the highest (if not the highest) DUI arrest rates in the state of Illinois.

I’m no lawyer but I don’t feel it’s constitutional. You’re being stopped and searched/observed with no reasonable cause. A high DUI rate is no reason to stop/search me.

Years ago I was taking my written test to renew my driver license.
The multiple choice question asked “After 12 am, what percentage of drivers are legally intoxicated?” I decided to skip the choices and wrote in “I don’t care because I’m not one of them.”
The DMV lady gave me a huge scowl.
Beware, Georgia law now also applies this principle to utility vehicles. They very conveniently forget to publicize this feature in order to ticket unsuspecting out of state drivers solely to increase revenue. A typical fine with State fees added will generally exceed $400.00 with two points added to your license. Cops could care less about the safety of the utility workers since they hide in an inconspicuous spot beyond the location of the utility vehicle. The utility vehicle is not required to put out warning cones or signs, they just have to turn on any color roof light. Any sharp lawyer can make a lot of money by winning a sizable class action suit to get this abomination ruled ambiguous or unconstitutional.
In Arkansas they used to have yearly MVI (Safety Inspection) done at Auto Service Shops or Gas Stations.
Then they did away with it in exchange for Random Roadside Safety Inspectons. Now AR LEO have the tool to pull you over and Search your Vehicle. This gives them TOTAL ACCESS to the vehicle to preform the MVI:
Interior to check Hibeam Indicator, Seatbelts and Parking Brake functionally.
Under the Hood to check Brake Fluid level, Emmision System Compliance.
In the Trunk to check Lights and Spare Tyre condition.
This provides total access to search for Drugs, Alcohol, Firearms any other Contraband Items.
And they Dont have to have Provide any Probable Cause.
Very Convenient isnt it ???

While they are checking for Seat Belt Compliance, Child Safety Seat Compliance, License, Insurance, and Registration Compliance, they can check the “immigration status” and hold for ICE to immediately have deport the illegal aliens and foreign nationals on expired visa, absconders etc.

CSPD loophole calls it a “Road Safety Checkpoint” - you could be pulled over for a bad muffler, broken tail light or headlight, using a cell phone... etc...

However,my car had an expired inspection sticker and as I was driving away the cop on the other side yelled "sticker".The cop yelled "stop" but then a few seconds later said "go ahead".
It seems that our state Supreme Court had ruled that nobody other than drunks could be detained or written up at such roadblocks.
Unfortunately the state of Illinois believes that SCOTUS ruled them legal under a very narrow scope.
