Ruling Allows Openly Gay Men, Women to Sign Up

WASHINGTON, Oct. 19, 2010 Openly gay men and lesbian women now can apply to join the military, Defense Department officials said today.
The department issued guidance Oct. 15 to process paperwork for openly gay men or lesbian applicants. The instructions come from a California federal judges decision that the so-called Dont Ask, Dont Tell law is unconstitutional.
On Oct. 12, U.S. District Judge Virginia Phillips enjoined DOD immediately to suspend and discontinue any investigation, or discharge, separation or other proceeding that may have commenced under the Dont Ask, Dont Tell Act or its implementing regulations.
Pentagon officials said the department will abide by the judges order, and that part of that compliance is allowing openly gay people to apply to join the military. But citing uncertainty over final disposition of the matter in the courts and on Capitol Hill, a DOD spokeswoman said potential applicants must be aware that the situation may change.
Recruiters are reminded to set the applicants expectations by informing them that a reversal in the courts decision of the Dont Ask, Dont Tell law/policy may occur, Cynthia Smith said.
Phillips said yesterday that she is leaning against granting the governments request for a stay of her order. The Justice Department has indicated it will appeal her decision declaring the law unconstitutional to the 9th Circuit Court of Appeals.
The Defense Department wants a deliberative, long-range look at any changes in the law, said Pentagon spokesman Marine Corps Col. Dave Lapan. Defense Secretary Robert M. Gates set up a working group to examine the ramifications of a possible repeal of the law that bars gays and lesbians from serving openly in the military. The group is scheduled to submit its report Dec. 1.
The review that is going on would look at all the far-ranging impacts of what changing the law would mean, Lapan said.
A long-range plan for changing the law would include a period of transition to conduct training, to ensure that everybody was informed about new policies and procedures, Lapan explained.
In the current environment with the stay, you dont have the time to go through all these processes and make sure you determine what effect this has on housing, benefits, training on individuals across the board, he said.
The legislative remedy would allow that work to move forward, Lapan said, as the department would have the chance to study the impacts, to get the input from the force and to make adjustments and changes before an abrupt change in the law occurs.
Lapan said it is too early to draw any conclusions about Phillips stay and what is happening in the force.
I would caution against conclusions made from just a few days of having a stay in place, he said. A repeal of the law will have far-reaching effects. Now we are sort of in a holding pattern on discharges and proceedings related to enforcing the current law.
This does need to go to the Supreme court. There is no “right” to serve in the military. For the survival of the nation, it is reasonable to put prohibitions on those who serve to ensure good order and discipline of the Force.
And watch as all other enlistees drop off the radar... can you imagine a military made up of mostly gays? That would give a whole new meaning to “militant gays”.

They enter the political realm, make laws, tell Congress what the rules are for the Armed Forces, and order the executive to carry out their illegal diktats.

Military enlistments plummet, so a draft is reinstated. But it wouldn't be "fair" to just require young men to be drafted into the military....So why not require ALL young people , men and women, 18-25 (27? 29? 35?) to register for public service? Some of them would be moved into the armed forces as needed, the rest would be required to serve 12 (or 18, or 24, or whatever) months in Obama's civilian service corps that he mentioned wanting to create back in 2008.
If I was gay I don’t think I would enlist in the Marines and find out what if Code Red does exist.

Good point, but IIRC the Leftist, Socialist Democrats have been wee weeing about returning to the draft longer than that. Unless it’s a Shadow Party “thang” then Obama’s Civilian Army is a separate project me thinks.
Like I said though it’s a good point, and you could be right.
There’s been no word about the civilian army thing for so long now that I was starting to hope even BHO could see it was both unpopular and financially unfeasible. Then this scenario occurred to me, and I could see that it would give them a golden opportunity not only to destroy the armed forces, but to get the *^&%$#@ civilian corps . But maybe I was right the first time....I certainly hope so! The potential for mischief in this “civilian army” is obvious, as well as being “philosophically “ objectionable as it’s based (like the personal mandate) on the idea that we are government property.

If you look at the patterns, it is not impossible for there to be a flood of gay folks lining up to enlist? There was a flood to show their marriage licenses in CA up before proposition 8. I know my comparisons may seem fallacious, but this is politics going on here, and politics is not always the kind of logic that you expect. I believe it is likely that there will be at least a flood for the short time after the demand is made to show off the fact that they are supposedly no longer “oppressed” (their words, not mine).
Aside from the physical manifestation of gay presence in the military, the one that scares me is the spiritual: Wen God takes his hand of blessing because we chose to reject Scripture.
Conservatives may sweep the Nov 2 elections, but stand by for national judgment.
