I'm not taking a position one way or the other, I have been watching the "Birther" controversy with interest.
In answering my question, please go further than the obvious, in other words what would be the outfall and how would you handle the eventual constitutional crisis? Would Biden become prez? If he is no longer viable, would it then fall to Pelosi?
I'm asking the birther supporters to think long range about this.
Yep there are plenty of great conservatives who are constitutionally ineligible to become president. Its just the way it is and those that don’t like it can go find a place they do like.
I’d be concerned that the truth would continue to be denied, that conspiracy theories would abound, and that the end result would be concluded motivated on racism.
I would absolutely still want Tea Parties to continue until those freak-show persons in Congress & Senate get a clue. Would still want the GOP to find a conservative backbone and candidates that we can be proud of. Would want the folly of liberalism exposed as the danger that it is to our safety, economy, and way of life.
I would want this to be the kick off to a renewal of conservatism in America.

If the President is impeached or ruled ineligible or incapacitated such that he could no longer serve or dies (i.e. taken out of office for ANY reason); then the VICE PRESIDENT serves out the remainder of his term.
You would think a political party would perform due diligent in vetting their candidates thoroughly including requiring proof of citizenship beyond doubt ... but the party of liars and cheats won’t win until they slip one of theirs in the back door. They been doing it for years.
Where is their pride in the democratic process? .. but one must keep in mind where a bulk of the administration is drawn from, the cesspool of Illinois politics and leftist&econut groups.

There are two parts to the answer:
First, the biggest part of this shell game is that Obama and his operatives have convinced most of America that we have the burden of proving O is unqualified. While at the same time they have “sealed” and in one instance forged the very record that would be used for such purpose.
It is exactly the opposite, O has always had the burden of proving he is qualified. He acknowledged that burden when he signed or arranged for his agent(s) to sign each state’s primary election certification that he was qualified/eligible for the office of the president. Such execution, of course, was made under penalty of perjury.
Later, during the January 8, 2009 Joint Session called solely for the purpose of assuring America that the election was conducted properly, Obama had the burden of satisfying any request by Congress to demonstrate his citizenship (see 20th Amendment, “…if the President elect shall have failed to qualify…” as well as 3 USC 15).
Every liberal I have argued with has conceded that if Congress had required such prior to accepting the work of the Electoral College, Obama was obligated to produce, or to authorize Hawaii to produce, a verifiably authentic BC.
Should Congress have requested that document?
Without question, particularly in the face of the substantial pre-election concern and outrage transmitted to Congress over the fact that there was absolutely nothing in the public record that demonstrated O was a U.S. citizen.
He may be qualified, but there is no reason to believe so and Congress had a duty to the nation to act on the issue.
Which is why I have previously stated that every single Republican in Congress was seduced into going limp and sitting on their hands during the Session.
Second, as the issue gets closer to the top, O’s handlers will arrange for him to resign rather than risk what they have gained (much of which is in unread fine print). They will be happy with Biden and “his” selection Hillary. After that, it is just too risky to try to predict the future.

Past that, if Obama's out...it's hello, President Biden! Hasta be. But then what about the Constitutional clause requiring presidents to serve with their "original hair"?
Actually, Biden is sworn in only temporarily. Normal succession does not apply. The office would go to the next QUALIFIED candidate. So McCain would be sworn in. VP is a little more murky, but I would think that either Palin would also be sworn in or McCain would appoint her to fill the spot.

The constitution isn’t clear on this, which is why he’s asking. If you’ll read the thread, you have some posters who think the constitution prescribes a redo election, others think it would make Biden president, and yet others think that McCain and Palin would assume office. The question is who’s right? Personally, it’s nonsense, but no one is asking me.
What do the Constitution and the law say? Seems to me that there would be some uncharted territory involved.

Basically, this is the D’s problem. Anybody else wading into this looks like they are spoiling for a coup.
The right thing to do? Obama resigns the office and Biden takes over. Biden pardons Obama’s fraud charges, falsification of government documents, and various/sundry other offenses to avoid a real mess. Obama’s citizenship status is amended to what it actually is.
Unlike the military, you can’t be ‘qualified by position’. The fact he was a Senator doesn’t ‘grandfather’ him into being a US citizen. If he revoked, or wasn’t, a citizen, then he should apply for a green card, and then naturalize like every other resident alien.
If the D’s DON’T do something to take this out of the military’s backyard, then they will have a truly epic mess on their hands. 1000’s of active duty members challeging orders on the legality? Somebody with some sense on the left needs to get ahead of this.
I can’t believe I’m actually saying this, but Hillary could actually save the republic here. She’s the only one with the clout in liberal circles to get this done. She can probably put her hands on the evidence, take it to Reid, Pelosi, and the Chief Justice, and say, “This is what we ought to do.”
It’s not the mess that cause you to lose power, it’s how you clean it up. Hillary could look like a statesman here. Practically speaking, she’s likely got too many skeletons in here closet as well.
well, he would not get impeached, he would enjoy Huey Long-like immunity with this Congress. More likely mass civil disobedience (citizens refusing to obey laws and soldiers refusing orders signed by Obama, regarding them as invalid).
That’s unless his poll numbers tank so badly that other Dems start to regard him as a liability. Then all bets are off.
First of all, why are you using the liberals’ term for people who believe Soetoro is a fraud? We’re “birthers?” That is telling and I think BobJ knows where he falls on this.

IMHO Biden,Pelosi and Reid all bear some of the cover up of this which is technically treason. The Contitution has the remedy spelled out for a guilty charge of treason. After that IMHO there would have to be another election held shortly afterwards because I don’t thibnk the American people would stand for someone who was placed in the presidency
