WARNING LETTER
CERTIFIED MAIL RETURN RECEIPT REQUESTED
Mr. Robert F. Pasin President and CEO Radio Flyer, Inc. 6515 W. Grand Ave. Chicago, IL 60707
Dear Mr. Pasin:
The Federal Aviation Administration (FAA) has reviewed the markings of your Radio Flyer Classic Wagon and your Radio Flyer Retro Rocket Ride-On. FAAs review found serious violations of the Federal Aviation Act and of the International Civil Aviation Organisations resolutions 900.564.0004.1 (b) and 900.782.00230.1 (s). You can find copies of the Act and the FAAs website, http://www.faa.gov. The ICAOs resolutions may be found at http://www.icao.int.
UNAUTHORIZED AIRCRAFT
Based on claims made on your vehicles markings, we have determined that your Radio Flyer Classic Wagons and your Radio Flyer Retro Rocket Ride-Ons are promoted for conditions that cause it to be AIRCRAFT because the vehicles are intended to manipulate the imagination of THE CHILDREN, insinuating that they are capable of FLIGHT.
Your Radio Flyer vehicles are mis-marked within the meaning of FAR Part 119 because it bears unauthorized claims of capabilities of FLIGHT, therefore posing an immediate threat of irreparable injury to the MINDS OF THE CHILDREN.
This letter is not intended to be an all-inclusive review of your vehicles and their markings. It is your responsibility to ensure that all your products are in compliance with the Act and its implementing regulations.
Failure to promptly correct the violations specified above may result in enforcement action without further notice. Enforcement action may include seizure of violative aircraft and/or injunction against the manufacture and distributors of violative aircraft.
Please advise this office in writing 15 days from your receipt of this letter of the specific steps you have taken to correct the violations noted above and to ensure that similar violations do not occur. Your response should include any documentation necessary to show that correction has been achieved.
Please send your reply to the attention of Tyrone S. Wisecrack, Compliance Commissar, Federal Aviation Administration, US Department of Transportation, 800 Independence Ave., Washington, DC 20591.
Sincerely,
/s/
Edward Wojohowitz Director Potentate FAA Illinois District
I have absolutely no information about the bamboo poles, duct tape, tarp and wagon found hanging off the telephone lines in Signal Hill,’bout 45 years ago ;)
Was there a JATO involved?
Well, it asked for replies to be sent to Tyra S. Wisecup.
But it can be found on the FDA site:
http://www.fda.gov/foi/warning_letters/s7188c.htm
I suppose Ms. Wisecup is real.
The satire tag wasn't on the post originally.
What next, tennis shoes?
No pyrotechnics, just big hills and thoughts of Rogallo wings and spacecraft.
Sounds like my sled in Wisconsin. Long distance flying over snow banks...
And of course the ski-jumping....
I guess I did make it into the air many times...
We had one hill that was so fast that you could go into the air with your sled and do a barrel roll. What fun. Probably a felony these days though....
they probably also got one from the FCC ordering them to establish a community review board for their talk shows...
If true, they went off the deep end.
I bet it didn’t “fly” too well either.
