Howlin has been telling us that the private lab was running the same tests as the SBI. Nifong has been saying for some time that the defense lawyers were not saying all they knew about the SBI DNA tests. Maybe the SBI previously got the exact same result as the private lab and the defense didn't talk about it. Thus the tendency of Nifong to characterize the SBI DNA result as "inconclusive".

We know that the private lab did not get a perfect match with 100% certainty. As someone else posted upthread, perhaps the SBI has a higher standard for what constitutes a "match" as opposed to the private lab.

Perhaps all this has been known to both Nifong and the defense for some time and Nifong simply needed the private lab to call it a "match" when the SBI wouldn't?

Do you recall when the first DNA results were known? Was it before or after the photo lineup?

April 4: Photo lineup.

April 10: Final SBI (non) DNA results received.

April 11: Nifong says at NCCU case is not going away.

So the lineup occurred before the final results were released. It is said that the SBI sent out preliminary results prior to the final results. It is thought that the arrival of the preliminary results was what caused Nifong to shut up. Anybody remember when Nifong started keeping his mouth shut?

The guy was "smart" to be interviewed live shortly after the event. The phone records and ATM records are good, hard evidence of TIME.

I remember my son getting picked up by a trooper in NY for speeding. My son said he knew "absolutely" that he was not. The cop asked him if he was on drugs. According to a local attorney, this happens all the time in this town and the cop always wins "on his word". My son was distressed and regrets not fighting it but at the time, he was on his way to a new defense contract job.

The next problem he had, he called me for advice BEFORE doing anything. I told him what to do. He beat General Motors "in Court" by simply sending them certified letters, receipt return requested as this progressed. He was pretty happy. It was irrefutable evidence and the nuts and bolts of the case.

The damage done to Duke thus far has been immeasurable. This mess could not have happened at a worse time. Acceptance letters for incoming freshmen were out and the deadline for mailing back checks was May 1st. I bet Duke is already dipping into their waiting list and the 'summer melt' hasn't even started.

Then there is the little matter of alumni donations. The development office must be on Paxil.

it looks to me that ALL 13 locus parameters must be ID'd in a DNA profile submitted to the FBI for the NDIS (National DNA Index System), reading 6.5 at the link below. If (as generally acknowledged) Nifong has less than 13, IT IS NOT ACCEPTABLE AS IDENTIFICATION TO THE FBI.

I do not think the first SBI results were after the photo lineup. I know the defense team received the results at that time and the media found out about it around the 10th of April, but I am willing to bet Nifong had them for a week or so before handing them over to the defense.
I definitely think he had a preliminary results from the SBI before the photo ID.

What a farce....Too bad she picked two guys who had called a cab. There is a very, very narrow time frame for rape to have occurred by not just one....but three guys.

Assuming that each occurence took 2 minutes (hey, they're young), that leaves about 10 minutes for her to get dressed including putting on her shoes, fixing her hair, wiping her tears, fix her makeup, get rid of THEIR hair fibers on HER clothing, spray the rug with disinfectant to get rid of HER body fluids....and step onto the porch and smile for the camera.

Why hasn't anyone mentioned how big the bathroom was or where she was before she arrived (LATE) at the Duke House??

I can't even begin to tell you how P*issed this Mrs. Duke Alumna and this Mr. Duke Alumnus are at Duke. We were outraged when they allowed the terrorist group to talk and recruit on campus but this whole thing is a new low. Brodhead is going to use this whole affair to "Yalify" Duke and get rid of men's sports too. I think his plans may fail because he is going to need men's sports after admission acceptances fall off. From what I can tell the alumni are outraged at Duke's behaviour. It doesn't surprise me that an alumnus is helping out the cab driver. One of the lacrosse players said that the alumni has been the single most supportive group. This is what happens when you import lilly-livered blue state yankees into the south (see our screen name). They think they know the culture and all they know is their ivy-leagued ideology of racial politics. Hopefully there will be a change of venue to where rational red staters hold some sway.
