April 10: Final SBI (non) DNA results received.

April 11: Nifong says at NCCU case is not going away.

So the lineup occurred before the final results were released. It is said that the SBI sent out preliminary results prior to the final results. It is thought that the arrival of the preliminary results was what caused Nifong to shut up. Anybody remember when Nifong started keeping his mouth shut?

I do not think the first SBI results were after the photo lineup. I know the defense team received the results at that time and the media found out about it around the 10th of April, but I am willing to bet Nifong had them for a week or so before handing them over to the defense.
I definitely think he had a preliminary results from the SBI before the photo ID.
