First DNA link possible in lacrosse case

DURHAM -- Tissue found under the fingernail of an exotic dancer who claimed she was raped at a Duke University lacrosse party may match a player who was there, several well-placed sources said Wednesday.

Analyzing the tissue, scientists concluded it came from the same genetic pool and was "consistent" with the bodily makeup of one of 46 lacrosse players who gave DNA samples for testing, the sources said.

At the same time, scientists ruled out a possible match with any of the other 45 students, according to the sources.

If accurate, the fingernail tissue match would offer the first DNA evidence potentially linking the dancer and an alleged attacker.

But because a complete DNA pattern was not obtained from the tissue, it was not possible to match it with the nearly 100 percent certainty that DNA results usually offer, the sources added.

The dancer told police she clawed at three attackers as they raped and sodomized her for 30 minutes during the March 13-14 lacrosse house party at 610 N. Buchanan Blvd.

Roberts told Newsweek that players gave them mixed drinks. She did not drink hers; the other dancer drank half her glass, spilled it and then drank all of Roberts' drink. "She started stumbling," Roberts said. "When I think back on it, she had a glassy look in her eye."

Kim is describing a date rape drug effect, which is not consistent with the AV's detailed recall in the lineup.

How in the hell can they get away with this and who said "find me something, anything on the cab driver." Who authorized the arrest?

How long and how deep did they have to look to find this? This shows how desperate they are.

What does this exactly mean? The guy was a particular race?

This is what was said after the first round:
"The tests found DNA matches to two players, from a towel outside the bathroom and on another object, Cheshire said.

One sample was from a player's semen and another was a different type of DNA, Cheshire said. He said that was to be expected in a bathroom shared by the three men who lived in the house."

Are they talking about that "Different type of DNA?"

DEFENSE attorneys will have a ball with this:

"Investigators found no DNA under the woman's remaining fingernails, or on those taken during the search of the rental house at 610 N. Buchanan Blvd.

My guess is the sample didn't contain enough genetic markers for a MATCH. Same genetic pool and consistent are a much lower standared.

I said earlier that I suspected from the wording that the DNA was actually weaker than the article portrayed. Scientists won't call it a match, but the media has.

This also explains why the SBI didn't find any matches.. Without the requisite genetic markers, they weren't going to give this any type of classification regarding Identification.

(City Manager Patrick) Baker told NBC17 he has not spoken to the officer who the Duke officer allegedly overheard, but he has spoken to the officer's superiors. The only comment they had about the Duke officer's account was that no one on the Durham police force knows the source of the accuser's initial statement about being raped by 20 men.

So, the question is, did the Durham police officer actually make that comment?

"This is one of the questions I've asked," Baker said. "I've asked questions such as, 'Why was the case changed from intoxated person to sexual assault? Who made that decision? What was the reasoning behind what made him or her make that decision?' ve asked them about 25 questions and expect them to give me all 25 questions back."

Baker said he will have the answers to those questions in time for Monday night's City Council meeting and said he would share the answers with NBC17.

Court Appearance Resheduled
Also Wednesday, a judge rescheduled the next court appearance of one of the two players charged with rape, kidnapping and sexual assault.

Collin Finnerty was set to appear with fellow defendant Reade Seligmann on May 18. Defense attorneys said in a motion that District Attorney Mike Nifong had informed them he would not be able to complete evidence discovery by next week, so Superior Court Judge Ronald L. Stephens moved Finnerty's hearing to mid-June.

Reid Seligmann's attorney, Kirk Osborn, said his client was still scheduled to appear in court next week.

How long do you think it'll be before a Defense lawyer asks her, Wouldn't lying in this case be a way for you to a have your own little secret? The same reason you gave to explain why you committed a felony and stole $ 25,000.

They have yet to say where "Mother of the Year" was BEFORE she arrived at the Duke's house.

When she stepped onto the porch, her hair should have been pretty messy but she smiled for the camera and whoops...tripped. Everyone must have roared and that p***** her off.

I can remember Hubby stubbing his toe. I laughed like hell. Two weeks later, I stubbed my toe. Guess who laughed that time??

For some reason we, almost naturally, laugh at these things because we observe no serious injury...just a klutz in action. So here's this dancer...and she has a klutzy moment....

There's somebody on the DPD involved in this who is at least as prejudiced as Nifong and quite possibly has some personal animus against the lacrosse players or personal interest in the AV herself. I'm guessing that person is probably Mark Gottlieb, who appears to be calling the shots in the police investigation.

Is Gottlieb a client of Crystal or of Crystal's escort agency? Was Gottlieb around during the prostitution scandal in the 90s and managed to skate free? Is Gottlieb involved with the local drug scene? Do people in Crystal's crowd have something with which to blackmail Gottlieb?

Was Gottlieb one of the detectives who conducted the 8 hour police station interviews with the three housemates?Did something happen during those interviews that left Gottfried with a personal animus towards the lacrosse players? Maybe he just didn't like their looks or maybe they brought some attitude in to those interviews.

Or does Nifong have something on Gottlieb? Nifong was in charge of traffic court for some years. Was Nifong fixing DUI and other offenses for favored individuals and is now calling in his chits, at least on Gottlieb?

The ham-handed arrest of Mostafa and the apparent attempt to influence his testimony may actually amount to a crime, and is of a piece with the whole pattern of the police investigation in this case.

While other DPD officers appear to have been skeptical (e.g., the officer who was overheard saying Crystal was unreliable and changed her story, the officer on the scene who said she was just passed out drunk, etc.), one of the investigators, probably Gottlieb, is skewing the investigation and evidence-collecting process.

Why? The defense investigators need to be looking into this angle. Who knows how much corruption would be found in the DPD if the lid was pried off.

I'm still trying to comprehend why any of this Duke students would want to take her on. I doubt any of them are that desparate.

Why is City Manger Baker so involved?

Baker said he plans to report on his findings Monday night to the City Council, after he has a chance to speak to Sgt. John Shelton, the District 2 patrol supervisor whose cell phone conversation Day overheard.

Baker also said he tried Wednesday to pin down what officers said and did at the Kroger store on Hillsborough Road where they found the woman, and at Duke Hospital, where the overheard phone conversation took place.

From what he's heard from department higher-ups, Baker said, the initial contacts Durham police had with the woman triggered "a pretty fast-moving situation where it appears they're thinking one thing and trying to clarify it."

Day heard one side of the conversation, pulled it out of context and had "drawn his own conclusions from it," Baker said.

Baker added that he's decided a report to the council is in order because police need time to answer his questions, and because he has to finish work this week on a fiscal 2006-07 budget proposal that's due to reach the council on Monday.

The idea that DPD couldn't figure out who was overheard saying that Crystal claimed 20 men raped her and had changed her story, is simply false. The can and undoubtedly did figure out who said that within 10 minutes.

The City Manager is not in the know and therefore can plausibly claim to reporters when asked that he doesn't personally know which officer it was, and that senior people in the DPD he talked to didn't tell him.

As an aside, I would bet that the Duke campus security officers don't get a lot of respect from the Durham PD and so it is not surprising that a Duke officer is trying to learn something about what happened by looking over the shoulders of or overhearing talk among the Durham police officers.
