That's all I have. Can't happen soon enough in my opinion. Thoughts?

They have let every other challenge to this mandate apply.I don’t see them changing horses in the middle of a stream...

Roberts will rule it’s a tax, and Amy Conehead Barrett will mumble something from her empty sheet of paper.

This needs to be 6-3 killing the mandate.

Obama and Pelosi are on record saying it can't be done.

The mandates are being pushed from multiple federal directions, in addition to states and private compaines. Military, Medicare Service, Contractors, OSHA (this is the one I think they are agreeing to take), day care facilities, and I figure some that haven’t been thought up yet.

I think they will split it and say that he has authority as executive over government workers but not over private citizens. On a really good and honest day they would throw the mandates out entirely but I suspect they are product of the beltway and regardless of political leanings have bought into the Covid hysteria.

Surprised they found ‘standing’.

After last January I lost any respect I ever had for *any* court in this country.

The ruling *should* be unanimous, 1 to 0, with Thomas writing the majority opinion.

Most of the people on that twitter thread seem to believe SCOTUS will rule the mandates are constitutional. Alan Dershowitz, who knows law better than most of them, has written a book arguing that it would only be lawful if mandated by Congress. I suspect the Harvard guy is right.

I’m looking for that. I think from the wording it might be several cases combined but I only have that ‘breaking news’ blurb right now.

It won’t be that simple.

Diaper Joe has put this EO on all government commerce.

“They have let every other challenge to this mandate apply.”

They have allowed schools to require it of their students and hospitals require it for employees, (they are free to work and go to school elsewhere), and some mask mandates.

They have not however, heretofore, allowed federal or state governments to compel vaccination of their citizens. And if Biden walks in with his OSHA argument, I do not see that flying.

Either way, I will not be taking the mRNA vaccines EVER, regardless of what SCOTUS ‘thinks.’

I’m looking for that. I think from the wording it might be several cases combined but I only have that ‘breaking news’ blurb right now.

1. Some days ago, a panel of the U.S. Court of Appeals for the Sixth Circuit, acting on a motion filed by the Biden Administration, lifted the stay on the OSHA Emergency Temporary Standard that had earlier been issued by the U.S. Court of Appeals for the Fifth Circuit.

2. The original petitioners in the Fifth Circuit action then filed an emergency motion with the Circuit Justice for the Sixth Circuit (i.e., Brett Kavanaugh) to reimpose the stay.

3. A few days ago, Justice Kavanaugh directed the Biden Justice Department to file a response to the petitioners' motion by December 30, 2021.

4. Apparently, what the Supreme Court has announced this evening is that oral argument on this motion will be held on January 7, 2022.

I believe that this is what this is about. It was very unlikely that the Supreme Court would have granted the petitioners' motion without giving the government the opportunity to respond. That it wishes to hear oral argument speaks to the seriousness in which it holds the matter.
