I’m looking for that. I think from the wording it might be several cases combined but I only have that ‘breaking news’ blurb right now.

I’m looking for that. I think from the wording it might be several cases combined but I only have that ‘breaking news’ blurb right now.

1. Some days ago, a panel of the U.S. Court of Appeals for the Sixth Circuit, acting on a motion filed by the Biden Administration, lifted the stay on the OSHA Emergency Temporary Standard that had earlier been issued by the U.S. Court of Appeals for the Fifth Circuit.

2. The original petitioners in the Fifth Circuit action then filed an emergency motion with the Circuit Justice for the Sixth Circuit (i.e., Brett Kavanaugh) to reimpose the stay.

3. A few days ago, Justice Kavanaugh directed the Biden Justice Department to file a response to the petitioners' motion by December 30, 2021.

4. Apparently, what the Supreme Court has announced this evening is that oral argument on this motion will be held on January 7, 2022.

I believe that this is what this is about. It was very unlikely that the Supreme Court would have granted the petitioners' motion without giving the government the opportunity to respond. That it wishes to hear oral argument speaks to the seriousness in which it holds the matter.
