'Rust' Investigation Heats Up As Warrant Is Issued For Alec Baldwin's Phone

The investigation into exactly what happened on the set of the film Rust that led to a cinematographer's death is heating up. On Thursday, a search warrant was issued for actor Alec Baldwin’s cellphone.

According to an affidavit filed in Santa Fe Magistrate Court, authorities asked for the iPhone in order to examine conversations between Alec Baldwin and a violent crimes detective with the Santa Fe County Sheriff's Office.

The new development comes just weeks after Alec Baldwin's widely viewed ABC interview in which he said he never pulled the trigger. Baldwin claims that he was holding the Colt .45 while cinematographer Halyna Hutchins directed him to point it toward her. The gun went off, he says, killing Halyna Hutchins and wounding director Joel Souza.

Baldwin's attorney, Aaron Dyer, said he believes that the investigation into the conversations will only help to prove the actor's innocence. “We proactively requested that the authorities obtain a warrant so that we could take steps to protect Mr. Baldwin’s family and personal information that is clearly unrelated to the investigation,” Dyer said in a statement. “A phone contains a person’s entire life, and personal information needs to be protected. While they evaluate the phone information, we hope that the authorities continue to focus on how the live rounds got on the set in the first place.”

At this point in the investigation, it's tough to tell who will end up bearing the responsibility in the shooting death. Authorities say assistant director Dave Halls handed Baldwin the gun before incorrectly yelling out, "Cold gun." However, Halls’ lawyer, Lisa Torraco, has said that her client was not the one to hand the actor the gun.

Halls' attorney has also maintained that it is not the assistant director's job to check guns and ensure they do not have live rounds. That would be the job of the set's armorer, or weapons specialist. That person is 24-year-old Hannah Gutierrez-Reed, whose attorneys have suggested that someone tried to sabotage the movie by bringing a live round to the set.

Gutierrez-Reed told an investigator that no live ammunition “is ever kept on set.” She has also said that she checked the gun and made sure it was "not hot" before going on a lunch break and that very few people had access to the weapons.

In Baldwin's ABC interview, the actor said that he is not personally responsible and he does not feel guilt over the incident, but that "someone is responsible." He also said that the accident is the worst thing to ever happen in his life. He expressed sadness and empathy for Hutchins' family, especially her young son, who is now left without a mother.

Baldwin deleted his Twitter account a few days after the ABC interview.

If that was to conceal statements he made, it could be a crime of obstructing a crimminal investigation.

No...this is a Columbo case.

Just one more thing...Mr. Baldwin. Where were you when the armorer went to lunch?

Those casings should all have fingerprints and so would the trigger. He said he didn't fully cock the gun...But that is impossible. It will NOT fire unless it is fully cocked.

It still drives me nuts that "RUST" is about a man who accidently shot someone. AND that Baldwin co-wrote the script. Just too much of a coincidence.

Maybe re-title RUST to "Murder On My Mind"...

Baldwin claims he did not know what happened to his two employees until 45 minutes later. This is a monstrous lie.

Baldwin was holding a Colt .45 revolver. Call it a prop gun. Call it a replica. Makes no difference. It was a real powerful firearm capable of firing real bullets. Baldwin pointed it at a person standing about 2 feet away from him.

This sequence of events all occurred almost simultaneously: He fired the weapon, felt the kickback, heard the loud report, and saw the person in front of him fall.

Yet Baldwin said he didn't pull the trigger and he thought Halyna fainted. This not possible. The kickback told him he had fired the gun. The loud bang told him a live round was fired. He must have immediately seen blood from Halyna's wound and must also have seen the person standing behind her react to his wound. Yet Baldwin didn't check on them. He left the building and has been looking for ways to cover his ass ever since.

FOX and Bret Baier have caved to LIBspeak when Bret reported:

"The actor was holding the gun that fired the fatal shot, which also injured the movie's director."

It's surprising that FOX didn't describe Alec Baldwin as "an uninvolved bystander to the gun's fatal shooting."

This gun was a revolver was it not? Ergo, he pulled the trigger. Revolvers just don't fire by themselves.

He is worried about the lawsuit if he admits feeling guilty. The sound bite would kill him in civil court if he said he admits feeling guilty. So he should have never done the interview.

True, but a lot of times it’s what people do AFTER the crime that gets them caught. Do you really think he texted people before he shot her anything relevant? Or do you think he’s texted people after and said what he really did? Especially after his terrible interview? He could have said he did pull the trigger but couldn’t admit it on camera. Or that he does feel guilty but if he admits it he’ll get sued. That will play very well in front of a jury.
