There is an earlier precedent for what might happen. Major Stefan Cook sued Obama seeking a Temporary Restraining Order until Obama proved his eligibility (Cook v Obama). The Department of Defense then withdrew Major Cook’s deployment orders which meant that he had no standing to sue since he was not being deployed. Because Major Cook challenged his deployment, he was fired from his $120,000 a year job with defense contractor Simtech because he lost his security clearance. Major Cook, with Orly Taitz as his attorney then sued Simtech to get his job back. His lawsuit was dismissed.

N-S used the singular.

I believe Cook actually volunteered for deployment specifically so could he file suit. So it was no surprise that his orders were revoked.

I think it’ll be sooner than you think. The dam is getting more and more cracks in it. Eventually public opinion against 0thugga and his agenda that people will start tellin’ what they know, especially ones who don’t want to go down with the ship. Facing jail time certainly helps focus the mind.

Many of their orders and guidance were signed by George W. Bush or by earlier Presidents. Many were signed by the current Secretary of Defense, who was appointed by George W. Bush. Others, to be sure, were issued by officers appointed by Obama. I think it would be awfully difficult to isolate which orders are a direct result of Obama’s exercise of Presidential authority.

You and the LTC may be right that Obama’s authority lacks legal legitimacy, but the fact remains that that issue isn’t likely to be resolved in a court martial.

Honestly, I’m not really sure it’s a military officer’s place to question the President’s constitutional qualifications. The principal of military subordination to civil authority and the needs of military discipline weigh heavily against military personnel becoming involved in such issues.

Frankly, even if he’s right and he somehow succeeds, I’m not sure this is really a precedent we want to set. This is more properly a question for other civil authorities - Congress and the courts.

I checked in the directory of soldiers and Dr Terrence L. Lakin is indeed a LTC on Active Duty in the U.S. Army.

This guy is a little bit more than just a service member.

For you to even try and attempt to equate this man with cowards in the past who have tried to refuse orders is, well, an obamanation.
