The "Vexatious Requestor Bill" is moving forward. The Office of Taxation wants to fine people who are labeled "vexatious requestors" and Fukino has said there are 4-6 people who are all set to be labeled this. I am certain I am one of them. Fukino is asking for "facilitated passage" of this bill.
The comment will have the link to the testimony by Fukino and the taxation dept.
It will also have a link to the latest addition to my blog - a post describing how the DOH falsified the e-mail communications record in order to frame me as a "vexatious requestor".
They are out for blood.

Are there any Hawaii FReepers who are willing to help pursue the truth? Perhaps they would agree to make some of the FOIA requests. Surely we have some who can carry the torch further. The DOH seems to be getting very anxious . . .
In additon to the ‘vexatious requestor’ law, Hawaii is implementing a law that looks like it means more access to birth certificates. This is Senate Bill 2056. Basically they’re amending (pun intended) HRS 388-18 to allow in-person inspections of birth certificate, apparently by anyone who will show two forms of ID and pay $50, BUT they reserve the right redact anything on a certificate and will not allow you take pictures. I can’t make my story any more clear but you should certainly feel free to pitch the legislature story.
I am not sure why it’s so tricky to understand what happened with my UIPA request. The agency must tell me if the records don’t exist. ALSO the agency must tell me which law protects records that do exist but cannot, by law, be disclosed. I have two emails from the OIP stating this as well.

I requested invoices and receipts generated from the amendment to his record. I requested Obama’s own UIPA request to access and amend his BC. I was denied access all of those records. I was not informed that they don’t exist. I was informed what law protects them from disclosure to the public.
What am I missing???
Interesting. Sounds like they’d like to show his BC but redact any indication of amendments per his instructions to them. heh, heh.
And exactly how would a person redact the original? Are they going to put post-it notes and tear away at the paper? Are they going to black stuff out? They’re not going to show the original and they’re not going to leave anything there that anybody would want to see.
That whole thing is just stupid. Anybody can say they saw it but they have nothing to prove a thing. It’s just a scam to get $50 off of gullible people. And it gives Fukino the power to pick and choose what she shows on a BC depending on whose BC it is and who is looking at it.
Not a good idea - especially after the chief of the vital records dept searched online to see if a requestor was pro- or anti-Obama in deciding whether to tell the truth or lie to them in response to their request.
Thanks for the information. That’s assuming that Ex Post Facto Law gets followed though. Right now none of the laws are being followed in Hawaii, and that’s precisely the problem. That’s why they’re going for blood. And if nobody will enforce the laws I’ve already shown have been broken, who would enforce the Ex Post Facto Law?

Does anybody here live where they can get access to microfilm of the Honolulu Advertiser? I know there’s a place in California - where the College Football championship game was played. Jeesh, my mind is fried, I can’t even remember where that was. Anyway, they’ve got the microfilm there. Is anybody around there who might be willing to do some checking for me? I need to look for a specific obituary in a specific year.

Since Ex Post Facto laws are specifically prohibited by the US Constitution, Federal Courts would have jurisdiction.
What’s not clear is that you have to know the rules in order to understand why the responses to your requests lead you to believe the birth record was amended. What’s not clear is what the significance of an amended record is. Does it affect eligiblity? Was it a formality or maybe it was a change out of simple vanity?? I don’t think reporters see how these things connect. What’s the hook that would make a reporter want to pick up that story??

I have no idea what the amendment is, but the fact that there is any amendment cast 100% doubt on Obama’s COLB because no amendment is noted.
I don’t have the time or patience to explain it to deaf ears...ya know? Deaf ears or simple minds....either way, I’ve had my fill on explaining what should be apparent.
The more I read about this, the creepier, more horrible and Orwellian it gets.

While I don’t see a prohibition of them in the HI State Constitution, the following may be applicable:
