Leibowitz claims only states can decide whether noncitizens can vote. WTH?

They know they need the illegal votes or Democrats CAN'T WIN!

Can states legally allow non-citizens to vote in presidential elections?Yes, under the U.S. Constitution, states can legally allow non-citizens to vote in presidential elections.
Constitutional basis
The Constitution does not require U.S. citizenship as a condition for voting in federal elections (including for president). It leaves voter qualifications primarily to the states:
- For presidential electors: Article II, Section 1 says each state shall appoint electors “in such Manner as the Legislature thereof may direct.”
- For congressional elections: Article I, Section 2 (and the 17th Amendment for the Senate) requires that voters for Congress have the same qualifications as those for the most numerous branch of the state legislature.
The Supreme Court has confirmed this division of power. In Arizona v. Inter Tribal Council of Arizona (2013), the Court stated that the Elections Clause allows Congress to regulate the times, places, and manner of federal elections, but not who may vote. Voter qualifications are the province of the states. law.cornell.edu Historical practice supports this: In the 19th and early 20th centuries, multiple states allowed non-citizens (often “declarant aliens” who had declared intent to naturalize) to vote in state and federal elections. All states later restricted voting to citizens by the 1920s, but that was a policy choice, not a constitutional mandate.Federal law and the recent ruling
Federal statute 18 U.S.C. § 611 (from 1996) makes it a crime for non-citizens to vote in federal elections. However, as the October 1, 2026 district court ruling in the Chelsea Cox case held, this statute appears to exceed Congress’s authority because it attempts to set a voter qualification (citizenship) that the Constitution reserves to the states. That ruling is limited to one case and is not binding nationwide, but it reflects the constitutional principle.Current reality
- No state currently allows non-citizens to vote in presidential (or statewide) elections. Every state requires citizenship, either by statute, constitution, or both. Many states have recently added explicit “citizens only” language to their constitutions.
- Some cities/localities allow non-citizens to vote in local elections only (e.g., certain school board or municipal races in parts of California, Maryland, Vermont, and Washington, D.C.). Federal law permits this as long as the local portion is conducted separately from federal races.
Practical and political limits
A state could change its laws (and, if needed, its constitution) to allow non-citizens to vote for president. Doing so would automatically make those non-citizens eligible for congressional elections in that state as well, because of the constitutional linkage to state legislative qualifications. There is no federal constitutional barrier preventing it. Any such change would face intense political opposition, potential federal challenges, and practical issues (e.g., how ballots are structured), but the constitutional answer is yes—states have that power.

Come to think, the right to vote is one of the reminding privileges of US citizens. Now they are trying to take avay even this?!
This will obviously not stand on appeal, but yes, this is totally outrageous and would be abused to nth degree!
BTW, it is my understanding that that’s the law in Canada?!

Look for California, Washington, New York, Illinois to open voter roles to any one from anywhere to vote, including people residing in foreign lands. Chinese in China and Indians in India most welcome.

USSC needs to look at this on an emergency basis, if it’s already been through the appellate system.

“voter qualification (citizenship) that the Constitution reserves to the states.”
States lost the power to import the people they want in 1808.
Congress controls naturalization - 100%.
Naturalization = right to vote.
States control the elections.
Congress controls the aliens, and can punish them.
If there is an uncounted absentee ballot, the state can elect to count it. Congress can’t stop the state from counting it, but can punish the alien for submitting it.

The Fed Law is full of laws that tell the states how to do voting. . . everything from the 19th Amendment to Racial Voting Rights Acts to Motor Voter to the regulations on on voting systems that came in after Bush vs. Gore.
Article IV, Section 4: The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion;
A Republican form of government means a representation from the Several States based on CITIZENRY. Any State that allows non-citizens to vote is inviting a correction. If the State of California were to decide that anyone from Red China could vote by mail, would that be a State's matter only?

"China just sent in a request for a billion mail-in voter ballots." No kidding. Sarcasm acknowledged. I'd guess they're already being printed now for the mid-terms. Democrats contracting Chynee companies for pre-filled ballots. No legal checks. President Reagan said we're always only one generation away from losing the Republic (paraphrasing).
I sure wish that when certain places that have 110% vote returns for dems we could see some people in orange jumpsuits and shackles.
We joke about Biden's impossible 80 million votes. Wait until next time when Newsome/Harris/AOC get two hundred million.
If Chyna and the Global Cabal screw up, they might actually win by 300 million votes.
