As I’m thinking about it, a pardon doesn’t mean you can’t be prosecuted. It just means that whatever sentence you receive is removed. They could absolutely have a court-martial against him. And, I would think, they could imprison him while the trial is pending and during the trial.

And the trial could conceivably last a long, long time...

Exactly what would you convict him for?

His job included making the military combat ready.

A reasonable man at the time could have thought Covid vaccination was proper. An enemy might be able to place Covid patients where wind would blow virus particles into the noses of our military personnel.

Is it possible for the “PRE-EMPTIVE” Federal pardon to be rescinded?

Every one of these “pardons” issued by Joe Biden should be challenged, as they are far too sweeping in the degree of immunity being offered. All these pre-emptive pardons include the presumption of guilt on the part of the person being granted the immunity from prosecution, and very likely reflect on probable guilt on the part of the person granting the pardon. I cannot imagine of anything that is more self-serving on the part of Joe Biden.

If the pardon cannot be rescinded, then a civil suit for damages should be brought against the person of questionable veracity, and they be left with a mere subsistence level of financial support for the remainder of their days. Any income they may receive in connection with the proceeds of the civil suit should be forfeit, this includes any memoirs or published accounts.

An object lesson for generations to come.

Don't waste time with attempted prosecutions.

President Trump needs to work his announced agenda.

I don't see anything wrong with creating a truth commission and calling in those pardoned to give testimony.

Their pardons should prevent them from invoking the 5th.

And they would be unwise to commit perjury.

I doubt it.Military courts are basically Federal courts...so a Presidential pardon would have the same force for a soldier as it would for a Mexican gang banger fentanyl dealer.

Maybe Milley can be recalled to active duty and placed before a Marine Board of Inquiry. As for the rest of those that received preemptive pardons start referring to them as pardoned felons.

The good news is no they cant refuse to answer questions by congress. There is no 5th amendment protection when you are pardoned - since you cant be prosecuted.

Therefore, they must answer truthfully about anything they are asked. If they lie, a new crime has been committed for which they are not pardoned - then you can convict them for lying. If they tell the truth - we get to see under the rocks of all the bad things they were doing.

I am not in the know of the specifics. He cannot be tried criminally but reduction in rank and forfeiture of retirement does not sound criminal.

I would suggest Trump challenge the constitutionality of ‘preemptive pardons’.

Does it prevent the investigation of others who were involved in crimes? Or can you continue the investigations and trials, knowing they would be automatically pardoned if convicted. How do you get to the truth?

How can you ever pardon someone who had not been convicted?

Can you pardon TREASON? (the penalty being death)

The precedent is Ford pardoning Nixon, but that was wrong too- and the democrats argued that point at the time.
