President Trump is reelected, republicans hold the Senate, democrats hold the House
Democrats avoid subjecting themselves to a senate trial by saying the impeachment stands as is because it cannot be handed over from one congress to the next for a trial.

President Trump is reelected, democrats hold the House and take the Senate
Democrats could hand off the the impeachment for trial to a democrat senate in 2020.
Republicans might try to claim the impeachment cannot carry over to a new congress but democrats would just laugh at them.

This agrees with Vlad’s position that the Democrats make up the rules as they go alongm

Once the House votes to impeach, the Articles of Impeachment are transmitted immediately to the Senate. The Senate trial starts immediately.

The House can vote to impeach at any time: tomorrow, during the presidential campaign, or the day before the election. But once that vote takes place and the Articles of Impeachment are transmitted to the Senate, the House is out of the game except for appointing impeachment managers to present its case to the Senate for trial.

I sometimes think it would be useful politically too.

However I have to keep reminding myself most people don’t find “political battle” interesting. Most people are really put off by it. A Senate trial to show “We do thinks properly & fairly. Not like those partisan Rats!” is a lesson that will be lost on most. John Q Public just wants it gone out of their sight! A continued battle in the Senate will just reinforce the notion “They’re all the same!”. The McConnell led senate just dismissing it quickly will be doing an obvious partisan act, but an act most would be happy to see.

When an old Congress is “timed” out of office by an election, no business is carried forward to the new Congress chosen in the election. Everything, including impeachment, must start all over in the new Congress. This is basic black letter law.

Winners act a certain way, they have a certain vibe.

Pelosi and Biden are melting down.

Their behavior isn't what we'd expect to "feel" from someone who just won.

They would be jubilant and poised.

Or if "sore winners," they would be SMUG.

Is that how they feel to you? https://t.co/dNIFVzITk5— Mike Cernovich (@Cernovich) December 5, 2019

That could be true. Especially if they follow it with explaining why they’re not even going to give the allegations any credence.

But I still want to see all the evildoers squirm :-)

Thank you, that answers my question.

As soon as the House impeaches it goes immediately to the Senate.

The rabid dims in the House can’t sit on it.

“They would be jubilant and poised.”

Poised... no not a word I would use to describe Biden. Not when he calls a questioner fat and forgets what year he was vice president, lol. You really can’t make this stuff up!

I wasn't particularly outraged at Mueller. This feels malicious, less towards Trump, rather pointedly coercive to humiliate Trump supporters = worshipful of State cabal of unelecteds, nobles. Characterizing them as beacons of 'patriotism' that cannot be challenged.— Adam Townsend (@adamscrabble) December 5, 2019
