In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.

The Seventh Amendment serves to ensure that civil litigants are entitled to jury trials, much as the Sixth Amendment gives criminal defendants the right to be tried by a jury of peers. The amendment originated when it was noted near the end of the Constitutional Convention that no provision had yet been made for juries in civil cases. An attempt to add the provision was defeated, but the guarantee to the right of a jury in civil cases was one of the amendments urged on Congress by the ratifying conventions. The Seventh Amendment was finally passed without debate.

I hate how people think that the Constitution gives us rights. We have to keep reminding people that the Constitution gives no rights, it merely instructs government that it cannot take away our God-given rights.

What the Government givith, the Government can taketh... as opposed to say infringe/deny God-given rights.

At the time, there was a DEFINITION of “Twenty Dollars.” It was one ounce of gold.

Now there is no DEFINITION of “Twenty Dollars,” other than the meaningless definition, “A piece of paper on which the Federal Reserve has printed the words ‘Twenty Dollars.’”

It was the adoption of the Bill of Rights that spelled out the rights of the people to protect them from the Powers of the Constitution from being abused.

I always get a kick out of the placement of the 16th amendment to this "Guarantee"

AMENDMENT XVI Passed by Congress July 2, 1909. Ratified February 3, 1913. Note: Article I, section 9, of the Constitution was modified by amendment 16. The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.

It also includes ths word dollar. You can be sure that the people who wrote this and the people who read it did not have in mind a piece of paper with a picture of a dead President on it.

FYI: This is the passage often referred to by those who oppose jury nullification. Note it says no fact tried by a jury, which is then taken to imply that juries can only try facts and not law.

I understand the function of the amendment, but (1) it is a civil suit, where non-parties really do not care about the outcome, and (2) it seems to me that God was okay without jury trials over civil actions (see: Solomon).

I agree, but unfortunately most men cannot judge as justly as God can. If we could have Christ as our judge and ruler on this earth, we wouldn’t need the Constitution!

Thanks Cincinna for the kind remarks. I’m doing it mostly for myself, but it does make a nice series. The website I’ve been using (and will continue to) has a lot of idiotic screed, including by Charlie Reese, but I’ll only be able to do the original Bill of Rights, that’s all they have. Findlaw has all of ‘em; after I get through with the First Amendment, I’ll probably continue with #11 and work my way up. There are also some failed proposed amendments, but I think those have been covered before.

Given the state of jury pools these days, I’d just as soon take a chance with most judges as to trust the judgment of the jurors.
